2/19/10 Special Public Meeting Minutes:

The Board of Bear Lake County Commissioner met in a special session on February 19, 2010, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Rodney Wallentine, Treasurer and Bill Stock also attended the meeting.

LOCAL IMPROVEMENT DISTRICTS
The meeting was called to consider resolutions of intent to form Local Improvement Districts for the Skinner and South Liberty Irrigation Companies. The County is required to hold hearings on the formation of an LID on receiving petitions with the required number of signatures. The hearings were set for 7:00 and 7:30 P.M. on March 9, 2010. Commissioner Romrell made a motion seconded by Commissioner Kunz to adopt Resolution 2010-7 declaring the intention to form LID 2010-1 for the South Liberty Irrigation Company. Motion carried. Commissioner Kunz made a motion seconded by Commissioner Romrell to adopt resolution 2010-8 declaring the intention to form LID 2010-2 for the Skinner Irrigation Company. Motion carried.

RESOLUTION NO. 2010-7

A RESOLUTION DECLARING THE INTENTION OF THE COUNTY OF BEAR LAKE, IDAHO, TO CREATE LOCAL IMPROVEMENT DISTRICT NO. 2010-1 FOR THE PURPOSE OF FINANCING THE COSTS OF CERTAIN PUBLIC IMPROVEMENTS; DESCRIBING THE BOUNDARIES OF THE PROPOSED IMPROVEMENT DISTRICT AND THE PROPERTY PROPOSED TO BE ASSESSED FOR THE COSTS OF THE PROJECT; GENERALLY DESCRIBING THE PROJECT PROPOSED TO BE FINANCED AND THE ESTIMATED COSTS AND EXPENSES OF THE PROJECT; STATING THE COST TO BE PAID FROM A LEVY OF ASSESSMENTS ON PROPERTY INCLUDED WITHIN THE LOCAL IMPROVEMENT DISTRICT; STATING THE METHOD OF DETERMINING ASSESSMENTS; FIXING THE DATE, TIME, AND PLACE AT WHICH A PUBLIC HEARING WILL BE HELD TO CONSIDER PROTESTS AGAINST THE CREATION OF THE LOCAL IMPROVEMENT DISTRICT; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the County of Bear Lake, Idaho (the "County"), is a political subdivision operating and existing under and pursuant to the laws of the State of Idaho, and as such is authorized and empowered to create local improvement districts to finance improvements pursuant to Title 50, Chapter 17, Idaho Code;

WHEREAS, the Petitioners, owners of not less than 60% of the resident owners and/or 66 ?% of all owners of the real property within the proposed local improvement district, have filed a petition under Idaho Code § 50-1706, for the creation of a local improvement district to finance the costs of certain public improvements, and

WHEREAS, the Board is of the opinion that it may be in the best interest of the owners of property within the proposed local improvement district, and within the County, that the proposed local improvement district be formed and the proposed improvements be constructed.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF BEAR LAKE, IDAHO, as follows:

Section 1: The Board hereby determines and states that it is its intention to form a local improvement district, to be designated "Local Improvement District No. 2010-1 of the County of Bear Lake, Idaho" ("L.I.D. No. 2010-1"), to finance the costs of the project as hereinafter set forth.

Section 2: The boundaries of the proposed L.I.D. No. 2010-1 are: Township 13S R 44E, Sections 8, 9, 15, 16, 17, 20-23, 26-28. All property within the boundaries of L.I.D. No. 2010-1 (except property which is exempt from assessment because of government ownership) will be subject to assessment according to the method of assessment set forth in Section 5 of this Resolution.

Section 3: A general description of the project to be acquired (the "Project") is as follows: construction and installation of a gravity flow irrigation system on the South Liberty Irrigation Ditch, together with costs of engineering, legal services, publication, bond issuance costs and reserves, and other related expenses.

Section 4: The estimated cost of the Project is $1,881,834, of which $970,695 will be paid from a levy of assessments on the property benefited by the Project within L.I.D. No. 2010-1.

Section 5: The costs and expenses of the Project shall be assessed against the tracts, lots, and lands included in L.I.D. No. 2010-1 according to the benefit derived method of assessment, all as provided by Idaho Code § 50-1707.

Section 6: Tuesday, the 9th day of March, 2010, at the hour of 7:30 P.M., or as soon thereafter as the matter may be heard, at the School District #33 Board Room at 39 N. Fielding Street, Paris, Idaho, is hereby fixed as the time and place when and where the owners of the property to be assessed may appear before the Board and be heard as to the propriety and advisability of acquiring the Project, and which is the time and place when and where the Board will consider the creating of the proposed L.I.D. No. 2010-1 and financing the proposed Project, and hear all complaints, protests, and objections which may be made in writing and filed with the County Clerk on or before said time, by any owner of any parcel of land to be assessed.

Section 7: Written protests and objections to the creation of L.I.D. No. 2010-1 or to the manner of assessment or inclusion of property therein may be filed with the County Clerk at or before 1:00 o'clock P.M. on Tuesday, March 9, 2010, by any owner of any parcel of land to be assessed.

Section 8: Notice of Hearing substantially in the form attached hereto as Exhibit "A" shall be given as follows:

(A) By publication of such notice in a newspaper of general circulation within the County, which notice shall be published in two consecutive weekly issues or three consecutive daily issues, the first publication being at least ten (10) days prior to the date of said hearing.

(B) By mailing, at least ten (10) days prior to the date of said hearing, a copy of such notice to each owner of property, if known, or his agent, if known, within the limits of the proposed L.I.D. No. 2010-1, addressed to such person at his or her post office address, if known, or if unknown, to the post office in Montpelier, Idaho. Ownership of property shall be determined as of the date of the adoption of this Resolution.

Section 9: This Resolution shall take effect and be in full force from and after its passage and approval.

2/12/10 Special Public Meeting Minutes:

The Board of Bear Lake County Commissioners met in a special session on Friday, February 12, 2010, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

AGENDA
Multiplex use at the Fairgrounds was added to the agenda. Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the agenda as amended. Motion carried.

LOCAL IMPROVEMENT DISTRICTS
Joann Taylor and representatives of the Skinner and South Liberty irrigation companies presented petitions to form Local Improvement Districts. The formation of Local Improvement Districts would allow the companies to bond at a lower interest rate for improvement projects. The petitions appeared to be proper and complete. Joann will check with the attorney to insure that the proper steps are being followed.

MULTIPLEX USE
Commissioner Romrell reported that the Fairboard had been approached by a group wanting to use the multiplex for indoor roping and bull riding in the winter months. The Commissioners questioned the suitability of the multiplex for this purpose.

RIGHT OF WAY DONATION
Mitch Poulsen presented an acceptance of donated right of way document for approval. The right of way was for part of the bike path between the Utah boarder and Fish Haven Cemetery. The path is being financed by a federal grant with a small match from the County. The donated right of way would be used as part of the County's match. Commissioner Romrell made a motion seconded by Commissioner Kunz to approve the agreement subject to legal revue. Motion carried.

2/8/10 Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in regular session on Monday, February 8, 2010, beginning at 9:00 A.M in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Brent Bunn, Sheriff, Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Bill Stock, Kirk Rich, Alan Eborn and Rosa Moosman, Editor of the News Examiner, also attended the meeting.

AGENDA APPROVED
Local Improvement District Petitions and Health Department personnel changes were added to the Agenda. Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the agenda as amended. Motion Carried.

IRRIGATION PROXY
Commissioner Romrell made a motion seconded by Commissioner Kunz to appoint Rodney Wallentine as Proxy to represent the County at an irrigation company meeting. Motion carried.

ELECTED OFFICIALS MEETING
Treasurer Wallentine presented a tax cancellation. Commissioner Romrell made a motion seconded by Commissioner Kunz to approve the tax cancellation. Motion carried. Sheriff Bunn presented his monthly report. He reported an average of 7 prisoners per day during January. He also reported on the arrest of a North Carolina fugitive in Montpelier. He reported that avalanche danger was very high in the mountains.

COMMITTEE ASSIGNMENTS
Commissioner Romrell reported that the Fair Board was questioning the method of the Eastern Idaho Fair assessment to Counties. This will be added the agenda for the next four County Commissioner's meeting along with the NACO prescription drug program. Commissioner Rasmussen reported on the Bear Lake Regional Commission Legislative reception and progress on the interlocal agreement for emergency services.

STATE PARKS UPDATE
Kirk Rich reported that the Bear Lake State Parks Department was in good financial shape. The County Water and Snowmobile Funds are run cooperatively with the Sate Parks Department. Both of the County Departments are run with State user fees with no cost to County property tax payers. The invasive species program will be run by the State Parks Department this year. Mr. Rich reported that a new building for the State Parks Department in St. Charles was still on schedule for this fall. He asked the County to continue to rent current building until this was complete. He asked the Commissioners to hire a part time employee to help with the Boat Safety Program this summer.

NATIONAL FLOOD INSURANCE PROGRAM AND RESOLUTION #2010-06
Rick Fawcett presented an application and Resolution to be submitted to FEMA with a draft of a Flood Plain Ordinance for inclusion into the National Flood Insurance Program. Commissioner Romrell made a motion seconded by Commissioner Kunz to pass Resolution 2010-6 in support of the program. Motion carried.

National Flood Insurance Program Application Resolution
Resolution No. 2010 - 6

WHEREAS, certain areas of Bear Lake County Idaho are subject to periodic flooding, mudslides (i.e. mudflow), or flood-related erosion, causing serious damages to properties within these areas; and

WHEREAS, relief is available in the form of Federally subsidized flood insurance as authorized by the National Flood Insurance Act of 1968; and

WHEREAS, it is the intent of the Bear Lake County Board of Commissioners to require the recognition and evaluation of flood, mudslide (i.e. mudflow), or flood-related erosion hazards in all official actions relating to land use in areas having these hazards; and

WHEREAS, this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to the State of Idaho Disaster Act codified in Idaho Code Title 26 Chapter 10 Sections 46-1020-1024.

NOW, THEREFORE, BE IT RESOLVED, that the Bear Lake Board of County Commissioner do hereby:
1. Assures the Federal Insurance Administration that it will enact as necessary and maintain in force in those areas having flood , mudslide (i.e. mudflow), or flood-related erosion hazards, adequate land use and control measures with effective enforcement provisions consistent with the Criteria set forth for the National Flood Insurance Program in Part 60 Title 44 of the Code of Federal Regulations.

2. Vests the Bear Lake County Building Official with the responsibility, authority, and means to:

a. Assist the Administrator, at his request, in his delineation of the limits of the area having special flood, mudslide (i.e. mudflow), or flood-related erosion hazards.

b. Provide such information as the Administrator may request concerning present uses and occupancy of the floodplain, mudslide (i.e. mudflow), or flood-related erosion areas.

c. Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map, and identify floodplain, mudslide (i.e. mudflow), or flood-related erosion areas, and cooperate with neighboring communities with respect to management of adjoining floodplain, mudslide (i.e. mudflow), and/or flood-related erosion areas in order to prevent aggravation of existing hazards.

d. Submit on the anniversary date of the community's initial eligibility an Annual Report to the Administrator on the progress made during the past year within the community in the development and implementation of floodplain management measures.

e. Upon occurrence, notify the administrator in writing whenever the boundaries of the community have been modified by annexation or the community has otherwise assumed or no longer has authority to adopt and enforce floodplain management regulations for a particular area. In order that all Flood Hazard Boundary Maps and Flood Insurance Rate Maps accurately represent the community's boundaries, include within such notification a copy of a map of the community suitable for reproduction, clearly delineating the new corporate limits or new area for which the community has assumed or relinquished floodplain management regulatory authority.

3. Appoints the Bear Lake County Building Official to maintain for public inspection and to furnish upon request, for the determination of applicable flood insurance risk premium rates within all areas having special flood hazards identified on a Flood Hazard Boundary Map or Flood Insurance Rate Map, any certificates of flood-proofing, and information on the elevation (in relation to mean sea level) of the level of the lowest habitable floor (including basement if habitable) of all new or substantially improved structures, and include whether or not such structures contain a basement and if the structure has been flood proofed , the elevation (in relation to mean sea level) to which the structure was flood proofed;

4. Agrees to take such other official action as may be reasonable necessary to carry out the objectives of the program.

MINUTES
Commissioner Romrell made a motion seconded by Commissioner Kunz to approve the minutes of the January 11, 2010 minutes with a minor correction. Motion carried.

ROAD AND BRIDGE ISSUES
Greg Skinner presented his monthly report. He noted that snow plowing was less than a normal year. He asked for help in keeping tracked vehicles off of County Roads and a problem with snow piles from driveway plowing left in the County right of way causing damage to plows and graders. The Commissioners will look into an ordinance to address the problems.

SOLID WASTE
Todd Transtrum presented a proposal for purchase of a new garbage truck. He noted that due to new emission standards we could save money buying a 2009 truck before they were gone. The Commissioner decided to advertise for bids on a new truck.

NEW HOSPITAL BYLAWS
Rod Jacobson approached the Commissioners concerning updated bylaws for the Hospital Board. The bylaws were prepared by a consultant hired by the Hospital Board. Commissioner Kunz made a motion seconded by Commissioner Romrell to adopt the new bylaws. Motion carried.

PICTOMETRY CONTRACT
The Commissioners further discussed a proposed contract with Pictometry International for three dimensional digital imaging of the County. After discussion, Commissioner Kunz made a motion seconded by Commissioner Romrell to sign the contract subject to the addition of an annual appropriation clause. Motion carried.

PROCUREMENT POLICY AND ETHICS
The Commissioners again discussed a proposed procurement policy for the County. They settled on a threshold of $10,000 for purchases requiring Commissioner involvement and minor spelling changes. Commissioner Romrell made a motion seconded by Commissioner Kunz to adopt the policy. Motion carried. The Commissioners also agreed to a policy to have County employees read and sign the State Ethics Manual.

ANNUAL AUDIT
Gary Teuscher presented the annual audit of the Counties Finances. The County's net assets and ending fund balances increased significantly during the year reversing a 6 year trend of deficit spending. Full funding of Payment in Lieu of Taxes by the Federal Government contributed significantly to this turnaround. State sales tax and revenue sharing was down due to the weak economy.

 

 

PUBLIC WORKS LICENSING
Chris Jensen, Idaho Division of Building Safety, met with the Commissioners to discuss public works contractor licensing. He discussed bidding requirements and when licensing was required.

EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Romrell to convene in executive session per Idaho Code 67-2345(b, d and f) to discuss medical assistance claims, personnel issues and legal issues. All Commissioners voted yes in a roll call vote.

Following the executive session Commissioner Romrell made a motion seconded by Commissioner Kunz to act on medical indigent claims as follows:

Case No. 2009-35 - Approved - Medically indigent, medically necessary, obligated County, last resource.
Case No. 2010-02 - Approved - Medically indigent, medically necessary, obligated County, last resource, and emergency need.

CTD OIL AND GAS LEASES
Dick Padon, CTD, Inc., met with Commissioners to discuss Oil and Gas Leases on County road right of ways. They would like to lease the mineral rights for 10 years. Following discussion, Commissioner Romrell made a motion seconded by Commissioner Kunz to sign the leases subject to legal review. Motion carried.

NORTHERN ROCKIES ECOSYSTEM PROTECTION ACT
The Commissioners considered a request from Lincoln County Commissioners in Wyoming to support their position against the Northern Rockies Ecosystem Protection Act. The bill would designate nearly 24 million acres of National Forest and public lands in the Pacific Northwest as wilderness and other federally protected designations. Commissioner Kunz made a motion seconded by Commissioner Romrell to write a letter opposing the bill. Motion carried.

WEB SITE
Commissioner Romrell made a motion seconded by Commissioner Kunz to extend the County's web site registration for a 9 year period for $161.91. Motion carried.

LOCAL IMPROVEMENT DISTRICTS
Joann Taylor and representatives of the Skinner and South Liberty Irrigation Companies presented petitions from the two irrigation companies to form Local Improvement Districts. The formation of an LID would allow the companies to bond for an improvement project at a lower interest rate than they can now get. Since one of the petitions did not have enough signatures the Commissioners agreed to meet later in the week to accept the petitions.

DISTRICT HEALTH DEPARTMENT
Representatives of the Southeast District Health Department met with the Commissioners to explain some organizational changes. The septic system inspector from Franklin County will now be inspecting in Bear Lake. They also discussed the criteria they use to approve septic systems.

Commissioner Kunz made a motion seconded by Commissioner Romrell to approve the current bills. Commissioner s Kunz and Romrell voted yes. Commissioner Rasmussen abstained as bills from the company he works for were included.
