5/20/09 Special Public Meeting Notice:
The Board of Bear Lake County Commissioners will meet with the Bear Lake West Homeowners Association on Wednesday, May 20, 2009, at 10:00 a.m. at the Bear Lake West Clubhouse, 155 U.S. Hwy 89, Fish Haven, Idaho, to discuss Bear Lake West Roads.
MEETING WITH COMMISSIONERS HAS BEEN CANCELLED
5/11/09 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners met in regular session on May 11, 2009, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members of the Board present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
Roger Jones, County Attorney, Lynn Lewis, Assessor, Rodney Wallentine, Treasurer, Greg Skinner, Road Supervisor, Rosa Moosman, Editor of the News Examiner, Todd Transtrum, Weed and Solid Waste Supervisor, and Bill Stock also attended the meeting.
MINUTES APPROVED
Commissioner Kunz made a motion seconded by Commissioner Romrell
to approve the minutes of the April 13, 2009, regular meeting
and the April 27, 2009, special meeting. Motion carried.
ELECTED OFFICIALS MEETING
Assessor Lewis reported that assessment notices would be sent
out soon. There was a short discussion of Agriculture land values.
Sheriff Bunn presented his monthly report. Average monthly jail
population had been 6.5% and medical costs $973. He reported
that he had received a $1,500 grant from Agrium to help with the
neighborhood watch program. He had made applications for grants
to pay for a drug dog and to pay for an additional officer for
three years. It was noted that the recent jury trial had required
lots of hours for police and court clerks.
COMMITTEE REPORTS
Commissioner Romrell reported on a recent Board of Equalization
training session he had attended. Topics in the regional transportation
meeting included a turn lane for the Saulls Subdivision on Highway
30 and work in the Alton Flats area.
ROAD AND BRIDGE ISSUES
Greg Skinner, Road and Bridge Supervisor, requested hiring two
temporary employees to work on projects that will be funded by
stimulus funds through the Forest Service. He was reminded to
get bids on any work in excess of $25,000. The County will bid
crack sealing and chip hauling for the St. Charles Canyon Road
project. The Georgetown Canyon project will be evaluated when
the snow melts. Summer projects include chip sealing in Dingle
and Eight Mile and repairs to Loveland Lane.
AIRPORT HAY BIDS
The Commissioners opened bids for hay at the Airport. The following
bids were received:

Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the high bids of Fred Nate for the South and Chad Hulme for the North. Motion carried.
SOLID WASTE ISSUES
Todd Transtrum gave a landfill update to the Commissioners. The
Affordable Housing Coalition was going to tear down a house and
wanted to use the landfill at no charge. City clean-ups were
underway at no charge. He reported that revenue generated by
the scale was not meeting expectations, but regulators were much
more accommodating regarding our small landfill designation.
He also talked about the move across the road and the shooting
range relocation.
TAX DEED HEARING
Commissioner Romrell made a motion seconded by Commissioner Kunz
to open a public hearing regarding tax deeding three properties.
Motion carried. Treasurer Wallentine presented the three properties
that were scheduled to be tax deeded to the County on June 1st
if taxes were not paid. No one appeared on behalf of the properties.
The properties will be posted prior to tax deeding. Commissioner
Kunz made a motion seconded by Commissioner Romrell to close the
hearing. Motion carried.
BAILEY CREEK ROADS
Dennis Duehren, District Forest Ranger, discussed the possibility
of changing a road location in Bailey Creek that provided forest
access. The land where the road providing access is now located
was recently sold. The land owner needs to bring a proposal to
the Commissioners. Mr. Duehren also discussed a parking problem
in the same area. A group of citizens had expressed concern regarding
the lack of parking for access to the Bailey Creek Trailhead.
There had been "no parking" signs placed along part
of the road. The Commissioners will check to see who put up the
signs.
STIMULUS AND RAC GRANTS
Dennis Duehren, District Forest Ranger, met with the Commissioners
to discuss the funding of several projects, which the County will
do with Forest Service money received as stimulus money or Regional
Advisory Committee funds under the Craig-Wyden Act. The RAC jobs
were a new bridge on the Nounan Road at Pearl Creek and the designing
of a fish ladder over an irrigation ditch on Georgetown Creek.
The Stimulus money projects include sealing cracks and a chip
seal of the St. Charles Canyon Road, increased parking at Montpelier
Reservoir and road work in Georgetown Canyon. The Commissioners
had previously approved an agreement to do the stimulus funds
projects and agreed to approve the RAC agreement subject to review
by their attorney.
BAILEY CREEK VISTAS PRELIMINARY PLAT
Mitch Poulsen and Judy George presented information on the preliminary
plat application for Bailey Creek Vistas. The Planning and Zoning
Commission recommended approving the preliminary plat subject
to several conditions. The biggest concern was bringing the road
up to County standards. The Commissioners decided to hold their
own public hearing on the application to correct a possible open
meeting violation. The hearing was scheduled for 2:00 P.M. on
June 8, 2009.
CULVERT PLACEMENT AND APPROACHES
Greg Skinner, Road Supervisor asked for Wayne Davidson, Building
Inspector's help in enforcing culvert and approach standards.
Wayne agreed to help with inspections.
ANNUAL AUDIT
Gary Teuscher, CPA presented the Audit for fiscal year 2008.
The County again ran a deficit due in part to very high fuel prices,
heavy snow fall and flat State and Federal revenues. The Commissioners
and the Clerk felt that 2009 would show turnaround from deficit
spending.
PUBLIC COMMENT
Bill Stock commented that individuals should be financially liable
for their own culverts and approaches.
EXECUTIVE SESSION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene in an executive session per Idaho Code 67-2345(a, b,
and d) to discuss medically indigent claims, personnel issues
and a legal matter. All Commissioners voted yes.
Following the executive session Commissioner Romrell made a motion seconded by Commissioner Kunz to act on the following medically indigent claims:
#2009-03 - Denied - Not indigent; Not last
resource, Didn't cooperate; Application is incomplete; No emergency.
#2008-22 - Approved - Indigent; Obligated County; Last Resource;
Emergency Need; Medically Indigent.
SOUTHEASTERN DISTRICT HEALTH DEPARTMENT BUDGET
Ed Marugg presented the 2010 District Health Department budget
request to the Commissioners. Although the District is asking
for no increase from the eight counties that make up the District,
Bear Lake's contribution will increase 3.22% due to increasing
property values in relation to the other Counties. In another
Health Department matter, Commissioner Kunz made a motion seconded
by Commissioner Romrell to retain Keith Martindale as the County
representative on the Health Department Board. Motion carried.
AIRPORT IMPROVEMENTS
Monte Transtrum and Ezra Lance, Airport Board, met with the Commissioners
to discuss upcoming improvements at the Airport. Major improvements
scheduled for this year are runway pavement maintenance and electrical
improvements including replacing the beacon. Total costs of the
improvements will be $306,187 with FAA paying 95% and the State
and County each paying 2.5%. Commissioner Romrell made a motion
seconded by Commissioner Kunz to approve the Airport Board's recommendation
to retain T-O Engineers to do engineering at the airport for the
next five years subject to the review of the agreement by the
County Attorney. Motion carried. Commissioner Rasmussen noted
that Garden City was still interested in making the airport a
regional airport.
BLACK BEAR RESORT UPDATE
Bruce Barrett and Ted Galovan presented a letter to the Commissioners
outlining their progress on various components of the Black Bear
Resort. They stated that local accounts payable would be caught
up this week and that construction liens were a result of over
billing by contractors and were being resolved in the courts.
They also discussed progress on water and access issues. They
were optimistic that the credit markets were loosening and that
they would be able to meet all of their financial obligations
in the future.
MONTPELIER COMMERCIAL BUILDING INSPECTIONS
Montpelier Mayor Reed Peterson and City Building Inspector Paul
Hess met with the Commissioners to reach an agreement for County
Building Inspector Wayne Davidson to perform Commercial Inspections
for the City. They agreed that the City will keep 10% of the
inspection fee.
LANDFILL PLANNING
Bruce Olenick, DEQ, presented strategies for short term, mid term
and long term planning for the landfill. He was pleased with
the addition of the scale and the ongoing data collection process.
This will help with mid and long range planning. He will continue
to work with the county in formulating a plan.
BOARD OF EQUALIZATION
Commissioner Kunz made a motion seconded by Commissioner Romrell
to convene as a Board of Equalization. Motion carried. Clerk
Haddock presented a list of Circuit Breaker application for submittal
to the State Tax Commission. Commissioner Romrell made a motion
seconded by Commissioner Kunz to approve the submittal of the
applications to the State Tax Commission. Motion carried. Commissioner
Kunz made a motion seconded by Commission Romrell to close the
Board of Equalization and reconvene in regular session. Motion
carried.
BILLS APPROVED
Commissioner Kunz made a motion seconded by Commissioner Romrell
to approve bills current bills. Commissioners Kunz and Romrell
voted yes. Commissioner Rasmussen abstained as bills from the
company he works for were included.
