6/25/09 Special Public Meeting Minutes:
The Board of Bear Lake County Commissioners met in a special session on June 25, 2009, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman of the Board, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
The Commissioners met with various elected officials and department heads to discuss their budget requests for the 2010 fiscal year.

6/22/09 Special Public Meeting Minutes:
The Board of Bear Lake County Commissions met as a Board of Equalization per Idaho Code 63-501 on June 22, 2009, beginning at 9:00A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board. Commissioner Rasmussen was on vacation.
Lynn Lewis, Assessor and Lori Haddock, Appraiser also attended the meeting.
Commissioner Kunz acted as Chairman in Commissioner Rasmussen's absence. The Commissioners considered three appeals of property assessments.
Keith Stuck asked that a lot in Paris be lowered from $19,350 to $5,000.
Scott Williams asked that a lot in Bloomington be lowered from $26,400 to $15,000.
Lloyd Barker asked that a lot in Bear Lake West be lowered from $91,000 to $70,000.
The Commissioners heard evidence from the Appellants
and from the Assessor. Decisions will be made in the July 13,
2009 meeting of the Board of Equalization.

6/16/09 Special Public Meeting Minutes:
The Board of Bear Lake County Commissioners met in a special session on June 16, 2009 beginning at 9:00 A.M. in the School District #33 board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
Gary Ratzlaff, Brent Nichols, Lee Radford, Bill Stock, Loren Webster, Wayne Davidson and George Frazure also attended the meeting.
BAILEY CREEK ESTATES SUBDIVISION
County Engineer George Frazure discussed a letter he had sent
to Planning and Zoning addressing the road issues in the subdivision.
Following discussion of the road issues Commissioner Romrell
made a motion seconded by Commissioner Kunz to approve the Preliminary
Plat subject o all of the terms in the Planning and Zoning letter
to the Commissioners and a further clarification of the road grades.
The developer will build a turnaround above a steep grade on
a current road and all roads will be approved by the Road and
Bridge Foreman and the County engineer. Motion carried.
Clerk Haddock will work with Mitch Poulsen to write a development agreement to be signed by the County and the developer.

6/8/09 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners met in regular session on June 8, 2009, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
Brent Bunn, Sheriff, Rodney Wallentine, Treasurer, Rosa Moosman, Editor of the News Examiner, Todd Transtrum and Bill Stock also attended the meeting.
AGENDA
Pegram dogs, budget discussion, and portable bleacher proposal
were added to the agenda. Commissioner Kunz made a motion seconded
by Commissioner Romrell to approve the agenda as amended. Motion
carried.
ELECTED OFFICIALS
Sheriff Bunn presented his monthly report. Average jail population
was 5.3 prisoners per day. The department had to make 3 transports
to Twin Falls for mental holds due to lack of room in Pocatello.
The Sheriff reported that he had exhausted his jail budget with
4 months left in the fiscal year. Jail populations are down state
wide and Caribou had concerns regarding losing some state prisoners.
The Commissioners discussed an ongoing issue with an over crowded
dog kennel in Pegram. Steps will be taken to resolve the situation
soon. Treasurer Wallentine presented information on 2 properties
he had tax deeded. He suggested getting the properties sold and
back on the tax rolls. Clerk Haddock reported on changes made
by the Legislature to the Election, Indigent and Open Meeting
statutes.
LANDFILL
Todd Transtrum met with the Commissioners to discuss closure of
the current dump site being used at the Landfill. Money has been
set aside for the closure. He may be short handed at the scale
if his current staff helps with the closure work. He also discussed
plans to adjust the onsite dumping fees.
FIRE DISTRICT REQUEST
Craig Bunn and Allyn Phelps, Bear Lake County Fire District, met
with the Commissioners to request a share of the County's PILT
receipts. The Fire District is a separate taxing district with
its own levy. The Commissioners will consider the request in
the budget process, but it was noted that other taxing districts
in the County could have the same expectation if the request were
granted. The Commission complimented Don Burdick and the Fire
District for the job they do.
MONSANTO NEW MINE
Representatives of Monsanto met with the Commissioners to present
details of a new mine they planned to develop near the Blackfoot
Bridge. The reserves at their current mine at South Rasmussen
Ridge were nearly exhausted. The new mine would use state of
the art environmental techniques. The Commissioners were generally
supportive and will consider a resolution in support at their
next meeting.
LEGAL REPRESENTATION
David McGuire, Pocatello Attorney, met with Commissioners to offer
his services if the Commissioners wanted to act as interveners
regarding the new Monsanto mine.
SENIOR CITIZENS CENTER
Allen Lloyd asked the Commissioners to continue funding for the
Senior Citizens Center. He noted that funding for seniors was
being cut at the State and Federal level. Transportation funding
had been cut, but the Center was continuing to provide the service.
The Commissioners complimented the operation of the Senior Center.
BUILDING CODE CHANGES
Wayne Davidson asked the Commissioners to make some small changes
to the building ordinances to formalize the Ag inspection fee
to check for set-back compliance. The Commissioners agreed to
the changes and will set a public hearing in the future to make
the changes.
TRANSPORTATION OVERLAY
Rick Fawcett and Derrick Sharp, Whisper Mountain Consultants,
met with the Commissioners to demonstrate the transportation overlay
they had completed. The overlay can be accessed on line and could
be made available to the public. The possibility of charging
for access was discussed.
BID OPENINGS
Bids were opened for two projects on the St. Charles Canyon Road
improvements. Bids received for the chip haul project were:
Thomas Rocks $20.50 per yard
Jack B. Parsons $24.00 per yard
Bids received for the crack sealing project were:
Accelerated Paving $24,100
Asphalt Maintenance $35,000
Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the lower bids of Thomas Rocks and Accelerated Paving. Motion carried.
PUBLIC COMMENT
Bill Stock suggested that it may be a good time to approach BLM
regarding a snowmobile parking area up Fish Haven Canyon. Claudia
Cottle updated the Commissioners on the North Eden pump back project.
Roy Bunderson asked about stimulus fund projects for the Forest
Service and whether this might interfere with regular road maintenance.
EXECUTIVE SESSION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene in executive session per Idaho Code 67-2345(1)(a, b,
and d) to discuss medically indigent claims and personnel issues.
All Commissioners voted yes.
Following the executive session Commissioner Romrell made a motion seconded by Commissioner Kunz to act on medical indigent claims as follows:
Case No. 2009-05 - Approved - Medically Indigent; Medically Necessary; Obligated County; Resident; Emergency; Last Resource.
Case No. 2009-06 - Denied - Not Medically Indigent; Not the Last Resource; Didn't Cooperate with the County; Application is Incomplete.
Case No. 2009-07 - Denied - Not Medically Indigent; Not Last Resource; Didn't Cooperate with the County; Application is Incomplete.
MINUTES APPROVED
Commissioner Romrell made a motion seconded by Commissioner Kunz
to approve minutes of the May 11, 2009 regular meeting. Motion
carried.
PORTABLE BLEACHERS
The Commissioners discussed a proposal to share ownership of portable
bleachers with a private group. It was decided to check with
ICRMP regarding liability issues before proceeding.
GEORGETOWN IMPACT AREA
The City of Georgetown presented a City Ordinance defining their
new City Impact Area. Commissioner Kunz made a motion seconded
by Commissioner Romrell to approve and sign the Ordinance. Motion
carried.
FENCE DAMAGE
The Commissioners considered a request of Max Fisher to pay for
fence damaged by a County snow plow. It was decided to pay the
claim and submit it to the insurance carrier.
AIRPORT AGREEMENTS
Following the Attorney's review Commissioner Romrell made a motion
seconded by Commissioner Kunz to sign a five year agreement with
T O Engineers for engineering work at the Airport. Motion carried.
Commissioner Kunz made a motion seconded Commissioner Romrell
to approve an agreement for some environmental clean up at the
Airport. Motion carried.
AUDIT APPROVED
The Commissioners signed the annual County audit that was presented
at the May meeting.
BILLS APPROVED
Commissioner Romrell made a motion seconded by Commissioner Kunz
to approve May's bills. Motion carried.

6/8/09 Special Public Meeting Minutes:
The Board of Bear Lake County Commissioners held a public hearing on June 8, 2009 at 2:15 P.M. to take public comment on the Preliminary Plat application of the Bailey Creek Estates Subdivision. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
Members of the public attending the hearing were Loren Webster, Richard Hydzik, Josh Torman, Judy George, Bill Stock, Gary Ratzlaff and Brent Nichols.
Commissioner Rasmussen explained the process
the hearing would follow. Gary Ratzlaff presented an overview
of the subdivision. It would contain 18 lots on 140 acres. Those
testifying for the subdivision were Loren Webster and Josh Torman.
Those testifying neutral were Richard Hydzik, Judy George and
Bill Stock. All who testified expressed concerns regarding emergency
service access and Forest access. Commissioner Rasmussen disclosed
a meeting that Commissioners Kunz and Romrell had with the developer
to look at the road situation. The Commissioners decided to consult
with the Prosecuting Attorney prior to making a decision.

NOTICE IS HEREBY GIVEN that the Bear Lake County Commissioners will hold a Public Hearing on June 8, 2009 at the Bear Lake School District #33 Board Room in Paris, Idaho at 2:15 P.M.
The purpose of the Hearing is to obtain testimony pursuant to the preliminary plat application for the subdivision known as the Bailey Creek Vistas. Information on the preliminary plat application is available at the Bear Lake Regional Commission Office, 305 West Logan Road, Garden City, Utah.
Testimony will be limited to information acquired outside of the Planning and Zoning hearing.
Written testimony can be mailed or faxed to the Bear Lake County Clerk, PO Box 190, Paris, Idaho 83261. Fax 208-945-2248.
Individuals who need accessible communications or other accommodations in order to participate in programs and services of Bear Lake County are invited to make their needs and preferences known to Kerry Haddock, Bear Lake County Clerk at least 3 to 5 days in advance. ADA/504 compliance.
