6/23/08 Special Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in special session on June 23, 2008 beginning at 9:00 A.M. in the Board Room of School District #33 in Paris, Idaho. Members present were Vaughn Rasmussen, Chairman, Montain Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Assessor Lynn Lewis and Deputy Assessor Lori Haddock also attended the meeting.

Commissioner Romrell made a motion seconded by Commissioner Kunz to convene as a Board of Equalization per Idaho Code 63-501. Motion Carried.

The Board reviewed and discussed with the Assessor the Assessed Value appeals that had been received. Mike Bird and Kay Beck appeared before the Commissioners to give testimony and present evidence on their appeals. No decisions were made.

The Board recessed until July 7 when final decisions will be made.

6/18/08 Public Meeting Minutes:

The Board of Bear Lake County Commissioners met in special session on June 18, 2008 beginning at 9:00 A.M. in the Board Room of School District #33 in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

BUDGET HEARINGS
The Commissioners heard various Elected Officials and Department Heads present their budget requests and asked questions of each.

AMBULANCE BUILDING BID
Layne DeClark met with the Commissioners to request an increase to his bid on the Ambulance building. His bid expired on May 31, 2008, but the bids were not opened until June 9, 2008. He explained that material prices had escalated and he needed an additional $6,000 to extend the bid. After discussion, Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the amended bid subject to checking the statutes concerning retainage. Motion Carried.

BLACK BEAR RESORT MASTER PLAN AND PHASE 1 PRELIMINARY PLAT
The Commissioners continued discussion of their June 9th meeting regarding the Black Bear Mountain Resort Master Plan and Phase 1 Preliminary Plat. Rick Fawcett answered questions about the agreements. The Commissioners expressed several concerns they had about the project including water and access. Following the discussion Commissioner Kunz made a motion to approve the Planned Unit Development Permit Agreement of Black Bear Mountain Resort. Commissioner Rasmussen stepped down as Chairman and seconded the motion. Commissioners Rasmussen and Kunz voted in favor of approval. Commissioner Romrell voted against approval.

Commissioner Kunz then made a motion to approve the Black Bear Resort Phase 1 Preliminary Plat. Commissioner Rasmussen stepped down as Chairman and seconded the motion. Commissioners Rasmussen and Kunz voted in favor of the approval. Commissioner Romrell voted against approval.

Meeting adjourned.

6/18/08 Public Meeting Notice:

The Board of County Commissioners will be meeting on Wednesday, June 18, 2008 at 9:00 A.M. in School Board Room in Paris, Idaho to hold Budget Hearings.

The Commissioners will also be meeting that afternoon at 3:00 P.M. to discuss Black Bear Mountain Agreements.

6/9/08 Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in regular session on June 9, 2008 beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Montain Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Brent Bunn, Sheriff, Greg Skinner, Road and Bridge Supervisor, Rosa Moosman, Editor of the News-Examiner, Tom Hulme, Griff Lloyd, Bill Pettis, Mitch Poulsen, Bill Stock, Jeannette Gailey, Monte Transtrum and Gary McKee also attended the meeting.

ELECTED OFFICIALS MEETING
Sheriff Bunn presented his monthly report. He reported that the City of Montpelier decided not to contract with the County for law enforcement. The dispatch center was nearly ready to move to Paris and he was exploring the possibility of 12 hour shifts for the dispatchers. Treasurer Wallentine presented property that would be tax deeded. Assessor Lewis informed the Commissioners that he had mailed assessment notices and was getting lots of questions.

RESERVE PHASE VI - FINAL PLAT
Mitch Poulsen and Gary McKee presented information on the Final Plat for Phase VI of the Reserve. Commissioner Kunz made a motion seconded by Commissioner Romrell to approve the final plat for The Reserve Phase VI subject to getting all required signatures. Motion carried.

JERICO HILLS SUBDIVISION - PRELIMINARY PLAT
Mitch Poulsen presented information on the Jerico Hills Subdivision Preliminary Plat. He presented a letter from the Planning and Zoning Commission recommending approval of the subdivision and outlined the conditions required for final plat approval. Commissioner Kunz made a motion seconded by Commissioner Romrell to approve the Preliminary Plat with the conditions as recommended by Planning and Zoning. Motion carried.

AIRPORT ISSUES
Monte Transtrum talked to the Commissioners concerning the Airport Board. They were having trouble getting a quorum at their monthly meeting. He suggested adding an additional board member. The Commissioners asked Mr. Transtrum to check the bylaws to see if quarterly meetings would be enough. It was noted that grant money for airport improvements were becoming less available. The Airport has made significant improvements over the past several years due to grant money.

COUNTY ROAD PLOWING
The Commissioners reviewed a list of private roads that are being plowed. It was determined that some of the roads were currently on the County road system or need to be added, some were plowed for safety reasons and some were plowed in trade for diking privileges. All others will be notified that the County will have to charge if they get plowed. Commissioners agreed that we need to have a policy and be consistent.

SENIOR CITIZENS CENTER
Griff Lloyd and Bill Stock reported on the Senior Citizens Center. They noted that they had raised the suggested donation for meals. They noted that the cost of running the Center continues to increase and requested money from the County to continue for next years budget.

BIRD REFUGE AGREEMENT
Annette de Knijf, Manager of the Bear Lake Wildlife Refuge, met with the Commission regarding an agreement to supply gravel from the County to the Refuge, which had expired before the Refuge had taken the tonnage of gravel agreed upon. She would like the Commission to extend the agreement. The Commissioners expressed concern that the County was running out of gravel, but would take the request under advisement.

MINUTES APPROVED
Commissioner Romrell made a motion seconded by Commissioner Kunz to approve minutes of the May 6, 2008 special meeting, the May 12, 2008 regular meeting, the May 16, 2008 special meeting and the June 3, 2008 special meeting. Motion carried.

ROAD AND BRIDGE REPORT
Greg Skinner, Road and Bridge Supervisor reported on activities in his department. He has been doing a lot of work on Loveland Lane. The road was not built with a proper base. He reported that the landfill scale will be here next week. He also noted that the increases in paving materials and fuel were rapidly depleting his budget.

AMBULANCE BUILDING BID
There was only one bid received for the construction of the new ambulance building. A bid of $193,386 was received from DeClark Construction, LLC. Commissioner Romrell made a motion seconded by Commissioner Kunz to accept the bid conditional on the bidder agreeing to extend the expiration date on the bid. Motion carried.

FENCING ISSUES
Rick Thomas presented a letter to the Commissioners regarding some fencing issues along Bloomington Dry Creek Road.

STRATEGIC ALLIANCE
Jim Mattson and Shawn Turner, representing the Strategic Alliance of Bloomington, Paris and St. Charles, presented a letter to the Commissioners expressing their concern over the effect that the Black Bear Resort might have on their water supply. They asked that all the water for the resort be approved prior to the approval of any phase of the resort.

BLACK BEAR RESORT MASTER PLAN AND PRELIMINARY PLAT PHASE 1
Judy George, Mitch Poulsen and Rick Fawcett presented information on the Black Bear Mountain Resort Master Plan and Preliminary Plat Phase 1. Ms. George presented a letter detailing the action of the Planning and Zoning Commission on the two applications. The Planning and Zoning letter recommended the approval of the two documents and outlined the conditions for approval of the Final Plat of Phase 1. Rick Fawcett, Whisper Mountain Consultants, presented details of the Planned Unit Development Permit. The water issue was discussed at length. Attorney Randy Budge explained the Bear River Compact and how water is mitigated in the Bear River drainage. Ernie Carlson, Idaho Department of Water Resources, explained the application process that the resort would go through with Idaho Department of Water Resources. The Commissioners wanted time to review the documents and scheduled a meeting for June 18th to continue the discussion and make a decision.

BLM ISSUES
Kyle Free and Dave Pacioretty, Bureau of Land Management, met with the Commissioners to discuss wildfire issues. They also told of plans to possibly develop a sandstone quarry on the East side of the Lake. They will send out a scoping letter.

SOUTHEASTERN IDAHO COMMUNITY ACTION AGENCY
Karen Briand, Deb Hemmert and Julia Campbell, SEICAA, met with the Commissioners to give a report on the services they provide for residents such as rental assistance, food bank, self help housing and other services. They asked the Commissioners to continue assisting with rent for their office and food bank space. The Commissioners asked them to look at the basement of the Health Department to see if it would suffice as an office. They will report back.

EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Romrell to convene in an Executive Session per Idaho Code 63-2345(1) to discuss medical assistance claims. All Commissioners voted yes.

Following the Executive Session, Commissioner Romrell made a motion seconded by Comissioner Kunz to accept or deny cases as follows:

MEDICAL ASSISTANCE CLAIMS
#2008-06 - Denied - Not medically indigent; Not last resource; Applicant didn't cooperate with County.
#2008-07 - Denied - Not a resident; Not indigent; Not last resource; Application incomplete; Didn't cooperate with County; Provider withdrew application.
#2008-08 - Approved - COBRA Premium payments only.

BEAR LAKE LEADERSHIP GROUP
Members of the Bear Lake Leadership Group met with Commissioners to propose the implementation of a curb side recycling program. They presented details of the plan and cost information. The group felt that the plan would pay for itself over the long run. More information will be gathered and there will be further discussions in the July Commissioners meeting.

BUILDING CODE AND INSPECTOR
Clerk Haddock reported that Wayne Davidson had accepted the position as Building Official and would start on June 13th. Commissioner Kunz made a motion seconded by Commissioner Romrell to adopt Ordinance 2008-1 adopting the Building Codes and Ordinance 2008-2 adopting the associated fees. Motion carried. The Ordinances will be effective upon publication.

ORDINANCE NO. 2008-1

AN ORDINANCE OF BEAR LAKE COUNTY ADOPTING THE 2006 EDITION OF THE INTERNATIONAL BUILDING CODE; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS OR STRUCTURES IN THE UNINCORPORATED AREA OF BEAR LAKE COUNTY; ADOPTING THE 2006 INTERNATIONAL RESIDENTIAL CODE, STRUCTURAL AND LIFE SAFETY PROVISIONS, AS THEY APPLY TO DETACHED ONE AND TWO FAMILY DWELLINGS; ADOPTING THE INTERNATIONAL ENERGY CONSERVATION CODE, 2006 EDITION FOR ALL RESIDENTIAL AND COMMERCIAL BUILDINGS, EXCEPT HUD CERTIFIED MANUFACTURED HOMES; PROVIDING FOR MANUFACTURED HOMES TO BE INSTALLED UNDER TITLE 44 CHAPTER 22 OF IDAHO CODE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF; REPEALING ANY AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH.

THE BOARD OF COMMISSIONERS OF BEAR LAKE COUNTY DO ORDAIN AS FOLLOWS:

Section 1. ADOPTION OF THE 2006 INTERNATIONAL BUILDING CODES:
That certain documents, three (3) copies of which are on file and are open for inspection to the public, one (1) in the Office of the Clerk of Bear Lake County and two (2) in the Office of the Bear Lake County Building Official, being marked and designated as the following:
The 2006 edition of the International Building Code (IBC), promulgated by the International Code Council, and amendments adopted under these rules together with
standards incorporated into the IBC by reference, including but not limited to, the 2006 edition of the International Residential Code (IRC) and the 2006 edition of the International Energy Conservation Code (IECC). Save and except such portions of the above mentioned codes as are deleted, modified or amended by provisions of this ordinance.
Shall be and the same are hereby adopted as the code of Bear Lake County for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in Bear Lake County providing for issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Building Code, 2006 edition published by the International Code Council, and the secondary publications references above, all of which are on file in the office of the Bear Lake County Clerk or Building Official are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance.

Section 2. DELETIONS, MODIFICATIONS OR AMENDMENTS:

All 2006 ICC Codes;
A. Insert Bear Lake County wherever [NAME OF JURISDICTION] is present.
B. All fees shall be established by the applicable governing authority under separate Ordinance or Resolution, with not more than 80% of paid fee's to be refunded, if authorized by the Building Official as allowed by code.

2006 International Building Code;
A. Sections 101.4.1 Electrical and 101.4.4 Plumbing shall be deleted, thus solely regulated under the State of Idaho IC 54-1001 and IC 54-2601.
B. Amend Section 903.2.7 by adding the following exception: Exception: Automatic sprinkler systems are not required in 3- or 4-unit Group R buildings
C. Amend Section 3410.2 inserting (adoption date) in place of [DATE TO BE INSERTED BY THE JURISDICTION]
D. All Appendices of the International Building Code, 2006 Edition, are hereby deleted.

2006 International Residential Code;
A. Table 301.2(1) shall be amended to read as follows:
Ground Snow Load = 45+, Wind Speed = 90, Seismic Design Category = C, Weathering = Severe, Frost Depth = 30", Termite = Slight/Moderate, Decay = None/Slight, Winter Design Temp = -4 (7277 HDD), Ice Shield = Yes, Flood Hazards = FIRM 160018 10/17/79, Air Freezing Index = 2000, Mean Annual Temp = 45º F.
B. Amend Section R404 by deleting Tables R404.1(1), R404.1(2) and R404.1(3) along with any reference to said Tables in Section 404.1.
C. The Exception to Section R405.1 is deleted and replaced with the following:
Exception: A drainage system is not required when the foundation is installed on well-drained ground or gravel-sand-clay mixture soils according to the Unified Soil Classification System, Group I and Group II Soils, as detailed in Table R405.1.
D. Amend Section R408.2 by adding the following exception:
Exception: Where warranted by climatic conditions, the total area of ventilation may be reduced to 1/1500 of the under-floor area where the ground surface is treated with an approved vapor retarder material and the required openings are placed so as to provide cross-ventilation of the space.
E. All electrical and plumbing requirements of Chapters 25 through 42 shall be deleted, thus solely regulated under the State of Idaho IC 54-1001 and IC 54-2601.
F. All Appendices of the International Residential Code, 2006 Edition, are hereby deleted.

Section 3. INSTALLATION OF MANUFACTURED HOMES: Manufactured Homes as defined by Idaho state Law and inspected by The Department of Housing and Urban Development (HUD), shall not be subject to the enforcement provisions of the aforesaid Building Codes, but shall be regulated and inspected as prescribed in Title 44, Chapter 22 of the Idaho Code. The owner, or an agent of the owner, must apply for and receive, an Installation Permit prior to placing any Manufactured Home on their property. No structural modifications may be made to any Manufactured Home or Manufacturers Installation Instructions unless a written site-specific structural analysis from a State of Idaho Certified Engineer or Architect has been approved, verifying the modifications compatibility with the Manufactured Home. All additions or alterations to any Manufactured Home must comply with all Building Code requirements. Multiple sections of Manufactured or Mobile Homes as well as Modular Buildings shall not be combined together or used for any other purpose except as approved by HUD at the time of manufacture. The Building Official or appointed representative is hereby authorized to permit, inspect and collect fees, as established by the governing body, for Manufactured Homes placed in Bear Lake County. Mobile or Manufactured Homes not bearing a HUD certification label shall not be allowed except as provided for by Title 44 Chapter 25 of Idaho Code.

Section 4. EXEMPTIONS: Agricultural buildings, as defined by Section 202 of the 2006 International Building Code, are exempt from building permits adopted herein but shall remain subject to placement requirements established by Bear Lake County Zoning regulations.

Section 5. PENALTIES: Violation of the provisions of this ordinance shall constitute a misdemeanor, punishable by fine of not more than $300.00, or by imprisonment not to exceed six months, or by both fine and imprisonment. Each day such violation continues it shall be considered a separate offense.

Section 6. REPEAL OF OTHER ORDINANCES / SAVINGS CLAUSE: Any and all other ordinances or parts of Ordinances in conflict herewith, are hereby repealed. All sections of the aforementioned Ordinances repealed by this Ordinance shall remain in force as to the authorization and enforcement of said Ordinances prior to the effective date of this Ordinance.

Section 7. SEVERABILITY: That if any section, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Bear Lake County Board of Commissioners hereby declares that it would have passed this ordinance, and each section clause or phrase hereof, irrespective of the fact that any one or more sections, sentences, clauses and phrases be declared unconstitutional.

Section 8. REFERENCE: Whenever "the governing body" or "local jurisdiction" is referred to in this Ordinance, or adopted codes, it shall be deemed to be referring to Bear Lake County, a political subdivision of the State of Idaho.
Section 9. BUILDING OFFICIAL: Whenever the term "authorized building official," or "building official" is referred to in the codes adopted by this Ordinance, such reference and designation shall be deemed to refer to and describe the "building official" of Bear Lake County, a political subdivision of the State of Idaho.

Section 10. EFFECTIVE DATE: That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect upon its due publication as provided by law, an emergency existing therefore.

AN ORDINANCE OF BEAR LAKE COUNTY ESTABLISHING THE FEES TO BE CHARGED FOR THE ISSUANCE OF BUILDING PERMITS WITHIN BEAR LAKE COUNTY; AND INSERTING THE FOLLOWING PERMIT FEE SCHEDULE, SET FORTH IN SECTION 1 OF THIS ORDINANCE AS TABLE 1-A OF THE UNIFORM BUILDING CODE, 2006 EDITION, AS ADOPTED BY BEAR LAKE COUNTY.

6/3/08 Special Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in a special meeting on June 3, 2008 beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Rosa Moosman, Editor of the News Examiner also attended the meeting.

CANVASS OF PRIMARY ELECTON
Clerk Haddock presented the results of the 2008 Primary Election held in the fourteen Bear Lake County Precincts.

County Candidates selected by the voters to appear on the November General Election Ballots were as follows:

Commissioner 1st District - Montain D. Kunz - Republican - 929 votes
Commissioner 2nd District - DeMar Romrell - Republican - 1329 votes
County Sheriff - Brent Bunn - Republican - 1156 votes
County Sheriff - Rex Skinner - Democrat - 120 votes
Prosecuting Attorney - Roger Jones - Republican 864 votes

Precinct Committeemen Elected:

Montpelier #1 - Mauria Teuscher - Republican
Montpelier #2 - Claudia Wigington - Republican
Montpelier #3 - Meriel Monical - Republican
Bennington - Kim Lewis - Republican
Bern - Keith Martindale - Republican

Commissioner Romrell made a motion seconded by Commissioner Kunz to certify the election as a Board of Canvassers. Motion carried.

GEM PLAN
Clerk Haddock presented a ballot from the GemPlan with four candidates for a Member At Large position on the GemPlan Board of Trustees. Commissioner Kunz made a motion seconded by Commissioner Romrell to vote for Commissioner Vaughn Rasmussen for the position. Motion carried.

FUTURE MEETING SCHEDULE
The Commissioners decided to move the July regular meeting to July 7th and the August regular meeting to August 4th to accommodate vacation schedules. The also set meetings on June 17th for budget hearings and June 23rd for Board of Equalization.

FROSTY SAGE KENNEL
The Commissioner considered a request of Frosty Sage Kennel to extend the deadline to reduce the dogs at the Kennel. After discussion, Commissioner Kunz made a motion seconded by Commissioner Romrell to extend the deadline to September 24th. Motion carried.

Greg Skinner, Brad Auger, Judy George, Mitch Poulsen and Ron Jensen joined the meeting in progress.

BLACK BEAR MOUNTAIN
Judy George, Ron Jensen and Mitch Poulsen presented the Planned Unit Development Permit and the Development Agreement for Phase 1 of the Black Bear Resort. The Planning and Zoning Commission had voted to recommend approval of both in their last meeting. They gave a summary of the conditions that had been established for approval of the Final Plat for phase 1. Judy George explained that their Attorney Stephaney Bonney had given an opinion that the water condition was more restrictive than allowed by the law. The Commissioners will need to work this out prior to finalizing the agreements. Consultant Rick Fawcett is working on this problem. The Commissioners will consider the documents in their June 9th meeting.

EXECUTIVE SESSION
Commission Kunz made a motion seconded by Commissioner Romrell to convene in executive session per Idaho Code 67-2345(1)(a) to discuss hiring a Building Inspector.
All Commissioners voted yes.

The Commissioners then drove to Grace for a joint meeting with the Commissioners from Caribou, Franklin and Oneida Counties.

THE COMMISSIONERS WILL THEN DRIVE TO GRACE FOR QUARTERLY FOUR COUNTY COMMISSIONERS MEETING WITH CARIBOU, FRANKLIN AND ONEIDA COMMISSIONERS, AT BERGY'S, 4 NORTH MAIN IN GRACE.
