7/31/06 Commissioners Special Meeting Minutes:

The Board of Bear Lake County Commissioners met in a special session on Monday, July 31, 2006 at 9:00 a.m. in the Commissioners Room of the Courthouse Annex in Paris, Idaho to discuss and define County roads/public access in Bear Lake County, the locations of Fish Haven Cluster Mail Boxes, the purposed east side of the Bear Lake Sewer District, and an Executive Session for Medically Indigent Claims and Personnel Issues. Board Members present: Dwight L. Cochran, Chairman, Conrad Michaelson, Vaughn Rasmussen and Colleen Freeman, Deputy Clerk. Kerry Haddock, Clerk was out the County.

Others in attendance at the meeting were: Mitch Poulsen, Planning and Zoning, Lynn Lewis, Assessor, Greg Skinner, Road & Bridge Supervisor, Rosa Moosman, Editor of the News-Examiner, Dan Fillion, Steve Howard, George Lane, JR and Lois Peterson, Kaye Petersen, Inez J. Batt, Kip Armatage, Roy Bunderson, Bill Stock, Dave and Sandra Allen, Leslie Crane, Rock Holbrook, Penny Fox, Tom Vesse, Susan Hayward, Bob and Jane Betley, and Conra Wallentine, St. Charles Postmaster.

FISH HAVEN MAIL BOXES
Commissioner Rasmussen welcomed everyone and presented an overview of the meeting agenda. He discussed the purposed cluster mail boxes to be built and placed at 4 different locations as presented by the US Postal Service to assist with mail delivery as the Fish Haven Post Office had been closed, thus making Fish Haven residents travel to St. Charles to obtain their mail.

Conra Wallentine, Postmaster for the St. Charles and Fish Haven areas presented to the Commissioners a letter along with pictures, costs and structural information for the cluster boxes and the 4 locations for them as follows: Lakewest Blvd; Lakeside Dr.; Loveland Ln; and US Hwy 89 at the Bear Lake Regional Commission. Discussion insued and concerns were voiced about who would maintain the boxes once they were built and placed at the locations and who would pay for more of them once the approximately 200 undeveloped lots in Bear Lake West were developed in the future?

Conra spoke about the structure and color coordination of the boxes for the areas they would be placed at. The Postal Service will be responsible for the base cost, which is the cement and the structure of all the boxes at each of the 4 sites. The Postal Service will only maintain the boxes on Loveland Lane and US Hwy 89 at the Bear Lake Regional Commission, as these two areas are on private property. The boxes on Lakewest Blvd. and Lakeside Dr. would not be maintained by the Postal Service. The Homeowners and Property Owners would be responsible for the costs of placing a shelter over them and for any damage to them in the future as they are in a development area.

After a lengthy discussion, Commissioner Michaelson made a motion, seconded by Commissioner Rasmussen to accept as purposed by the Postal Service, the cluster mail boxes at the 4 locations presented: Lakewest Blvd.; Lakeside Dr.; Loveland Ln; and US Hwy 89 at the Bear Lake Regional Commission. Motion unanimously carried.

EASTSIDE BEAR LAKE SEWER DISTRICT
Commissioner Michaelson discussed the efforts of the Regional Commission in pursuing the location and development of a sewer district for the east side of Bear Lake.

Mitch Poulsen, Regional Commission was asked what the cost would be and said the preliminary work would be covered by grant funding with a 50/50 cost share. DEQ would pay $40,000 to $50,000 and the other $40,000 to 50,000 would need to be from donated funds. DEQ would also take care of the grant process.

Commissioner Michealson made a motion, seconded by Commissioner Rasmussen to accept the proposal from the Bear Lake Regional Commission, in support only, to pursue the Preliminary Design and coordinate with DEQ in establishing a Sewer District on the eastside of Bear Lake and doing a preliminary study. Motion was unanimous.

REVIEW COUNTY ROADS
Commissioner Michaelson stated that objective of the meeting was to review the county roads and public accesses for these roads and to determine which right-of-ways would need to be kept open and which ones could be abandoned. The public was allowed to look at the maps presented and to give comment on these access roads.

After a brief discussion and review of the maps, Commissioner Michaelson stated that the current roads in question were as follows:

#1 - Mountain Way from Plat A to B
#2 - Loveland Lane to Fish Haven Canyon
#3 - Fish Haven Canyon to the Forest Boundary
#4 - Worm Creek Canyon to Bloomington Dry Canyon
#5 - Sleight Canyon to Little Valley Reservoir
#6 - Mill Canyon to Miles Canyon
#7 - South Stauffer to Forest Boundary
#8 - Bailey Creek Area (2 trails)
#9 - Fossil Canyon to Forest Boundary
#10 - Red Pine Canyon Road
#11 - Georgetown Right Hand Canyon Road
#12 - Joe's Gap to Forest Boundary
#13 - Home Canyon to Forest Boundary
#14 - Sheep Creek Reservoir to BLM
#15 - Sweetwater Creek/Dry Hollow
#16 - Cook Lane or 4th North - (Dingle)
#17 - 2nd North - (Dingle)
#18 - Sirrine Lane or 3rd South - (Dingle)
#19 - Eschler Lane - (Geneva)

The Commissioners agreed to obtain individual maps of each road in question, with a brief description as well as a large scale map that would be placed in various areas throughout the County asking for public comment on these roads prior to a public hearing to make a final decision.

EXECUTIVE SESSION
Commissioner Rasmussen made a motion, seconded by Commissioner Michaelson to recess the regular meeting and to convene an executive session to discuss medically indigent claims and personnel issues. Motion unanimously carried.

Commissioner Michaelson made a motion, seconded by Commissioner Rasmussen to adjourn the executive session and to reconvene the regular meeting. Motion unanimously carried.

INDIGENT DECISIONS
The Commissioners unanimously agreed to deny the following medically indigent claims:

#2006-24 - Not indigent; Not the last resource
#2006-25 - Not the last resource
#2006-26 - Not the last resource; Not an emergency

ROAD & BRIDGE
The Commissioners unanimously agreed to schedule 4 interviews for the August 14th meeting, for a part-time Road & Bridge Secretarial position.

7/10/06 Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in regular session on Monday, July 10, 2006 beginning at 9:00A.M. in the Commissioners Room of the Courthouse Annex in Paris, Idaho. Members of the Board present were Dwight L. Cochran, Chairman, Conrad E. Michaelson, Vaughn Rasmussen and Kerry Haddock, Clerk of the Board.

Rodney Wallentine, Treasurer, Ardee Helm, Attorney, Lynn Lewis, Assessor, Brent Bunn, Sheriff, Rosa Moosman, Editor of the News-Examiner, Bill Stock, Mr. and Mrs. Jay James, Mark and Gail Eborn and Steve Hardy also attended the meeting.

KENNEL APPLICATIONS
Prior to acting on two kennel applications, the Commissioners discussed the ordinance with County Attorney Ardee Helm. He explained that even if a permit was granted, individuals could ask for judicial review or file suit against the kennel owner. There is no legal reason for accepting or denying the permit application. It was strictly up to the discretion of the Commissioners. Commissioner Michaelson stated that he would like to amend the ordinance to include a distance requirement from the nearest neighbor and add some standards. Commissioner Michaelson made a motion seconded by Commissioner Rasmussen to approve applications for kennel permits submitted by Jay James and Heather Sauers. Motion was unanimous.

There was a short discussion regarding the effect of kennels on neighboring property values. It was noted that there are many things that are permitted in the County that can affect neighboring property values.

Greg Skinner, Al Harrison and Judy Holbrook joined the meeting.

ELECTED OFFICIALS MEETING
Treasurer Wallentine reported that 95% of property taxes had been collected. He also presented tax cancellations. Commissioner Michaelson made a motion seconded by Commissioner Rasmussen to cancel taxes as presented. Motion was unanimous.

Sheriff Bunn presented his monthly report and informed the Commissioners that long-time Chief Office Deputy Bernice Laughter was retiring. He also expressed concerns about his current year budget due to prisoner expenses.

Clerk Haddock presented results of the tax deeded property auction. Doug Taylor was the highest bidder on all six parcels that were auctioned.

HISTORICAL SOCIETY
Sherry Brown met with the Commissioners regarding the Historical Society Board appointments. The Commissioners reported that they had approached several individuals about the board positions, but had not received a commitment from any of them. They will be invited to the next Board meeting. Mrs. Brown also asked about funding for next year. The Commissioners informed her that they would be addressing this in the budgeting process, but that funds might not be available until taxes were collected in December and June.

KENNELS
Dani Woods, Lynda Jensen and Vicky Beck, representing Animals Need Help of Bear Lake, met with the Commissioners to explain their organization and offer help in the administration of the dog ordinance and insuring humane treatment of animals in the County. They presented some standards from several organizations around the Country for the humane treatment of dogs in kennels. The standards address basic cleanliness, fresh water, clean living areas, adequate ventilation, minimum cage size for the size of the animal, heat in the winter, food and vet care. They would like inspections to be part of the permit process. The Commissioners expressed appreciation for the offer of help.

Richard Armitage, Ken Ratcliff, Mitch Poulsen and Judy George joined the meeting.

COUNTY ROADS
Mitch Poulsen approached the Commissioners to seek guidance regarding County roads. He stated that there was no right-of-way on prescriptive easements. Rights-of-way are needed for utilities. Commissioner Michaelson stated that the County needed to define which roads in the County are County roads and whether they are defined rights-of-way or prescriptive rights-of-way. The County should make all the roads defined rights-of-way. Developers should help buy land needed for defined right-of-ways. Judy George stated that Planning and Zoning should help prioritize the acquisition of defined right-of-way roads.

BEAR LAKE WEST ROADS AND DRAINAGE
Richard Armitage and Ken Ratcliff presented a letter from the Bear Lake West Board of Directors regarding County services. The letter expressed that they were experiencing explosive growth compared with the rest of the County and they felt that the level of services provided by the County was inadequate in the areas of road maintenance, refuse collection and weed control. They stated that they would like to establish a new level of cooperation with the County and the services they provide. There was a discussion of the history of Bear Lake West roads and drainage plan. There was a 1991 agreement that the Homeowners Association would provide material and the County would provide the manpower to upgrade the roads. It was generally agreed that a long-range plan was needed to bring the roads and drainage system up to standard. The garbage collection issue was also discussed. Lack of lids on dumpsters and Utah residents using the County dumpsters were pointed out as problems. It was also noted that there was a need for more dumpsters and a better collection location. The Commissioners decided to hold a special meeting to work on defining which roads in the County are County roads.

BEAR LAKE CONVENTION AND VISITORS BUREAU
Judy Holbrook met with the Commissioners to update them on the activities of the Bear Lake Convention and Visitors Bureau and request a larger contribution from the County for next year. She reported that the Visitors Center above Garden City had opened and was receiving many visitors and showed some advertising of the valley that the bureau had placed in some tourism magazines.

BOARD OF EQUALIZATION
Commissioner Michaelson made a motion seconded by Commissioner Rasmussen to convene as a Board of Equalization to complete business. Motion was unanimous.

Robert and Marcella White asked to reduce the valuation of parcel 2231.00 from $86,890 to $68,000. The Commissioners approved the Assessor's suggestion to reduce the value to $71,000.

Commissioner Rasmussen made a motion seconded by Commissioner Michaelson to adjourn the Board of Equalization and reconvene as a Board of County Commissioners. Motion was unanimous.

MINUTES APPROVED
Commissioner Rasmussen made a motion seconded by Commissioner Michaelson to approve the minutes of the June 12, 2006 regular meeting and the June 26, 2006 special meeting. Motion was unanimous.

LANDFILL WELL
Commissioner Michaelson informed the Commission that the Department of Environmental Quality had approved our request to drill a test well for the County at the Landfill. The County will only have to level an area for the well.

EXECUTIVE SESSION
Commissioner Rasmussen made a motion, seconded by Commissioner Michaelson to convene an executive session to discuss personnel issues and medically indigent cases.

At the conclusion of the executive session, Commissioner Michaelson made a motion, seconded by Commissioner Rasmussen to adjourn the executive session and reconvene the regular meeting.

MEDICAL ASSISTANCE CLAIMS
Following the executive session the Commissioners unanimously agreed to deny the following medically indigent cases:
#2006-20 - Not the last resource; Medicaid/SSI Pending
#2006-22 - Application filed untimely; Not a Resident; Application incomplete; Not the last resource; Not indigent
#2006-23 - Services are not necessary; Not the last resource; No reciprocal agreement with Wyoming

#2006-18 - County previously approved for payment - applicant was recently approved for SSI - County never paid bills.

7/5/06 Commissioners Special Meeting Minutes:

The Board of Bear Lake County Commissioners met in a special session as a Board of Equalization on July 5, 2006 at 9:00 A.M. in the Commissioners Room of the Courthouse Annex in Paris, Idaho. Members present were Dwight L. Cochran, Chairman of the Board, Conrad E. Michaelson, Vaughn Rasmussen and Kerry Haddock, Clerk of the Board.

Lynn Lewis, Assessor, and Lori Stafford, Appraiser, met with the Board to consider assessment appeals.

The Board acted on the following valuation appeals:

Wayne Transtrum asked to reduce the value of parcel 2225.00 from $28,770 to $16,760. Board upheld the Assessor's valuation.

Jack Cleveland asked to reduce the value of parcel 2130.01 from $80,540 to $70,000. Board upheld the Assessor's valuation.

George Haymond asked to reduce the value of parcel 60131.00 from $7,710 to $300. Board upheld the Assessor's valuation.

Vaughn Price asked to reduce the value of parcel 31007.00 from $242,430 to $195,000. Board upheld the Assessor's valuation.
