2/11/08 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners met in regular session on Monday, February 11, 2008, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present: Vaughn N. Rasmussen, Chairman, Dwight L. Cochran, Montain D. Kunz and Kerry Haddock, Clerk of the Board.
Brent Bunn, Sheriff, Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Greg Skinner, Road and Bridge Supervisor, Rosa Moosman, Editor of the News-Examiner, Richard Armatage, Rex Skinner, Todd Transtrum and Bill Stock also attended the meeting.
ROTARY PLOW
Greg Skinner, Road Supervisor reported on the recent severe weather
and snow removal effort. He reported that there were some equipment
break downs and some private individuals had helped plow snow
at Bear Lake West. He asked permission from the Commissioners
to rent a rotary plow to clear some of the roads. The Commissioners
complimented the Road and Bridge Department for their effort during
the heavy snow period. After some discussion the Commissioners
agreed to rent the rotary for approximately 4 weeks.
ELECTED OFFICIALS MEETING
Sheriff Bunn presented his monthly report to the Commissioners.
He reported that Highway 89 in Montpelier Canyon was still closed
due to avalanches. The new Deputy Sheriff will start March 1st.
Sheriff Bunn presented the Forest Service operating agreement
which states that the Forest Service will pay the County for our
officers patrolling campgrounds. Commissioner Kunz made a motion
seconded by Commissioner Cochran to accept and sign the agreement.
Motion was unanimous. Clerk Haddock reported on a report of
the Idaho Transportation Department to the Idaho Association of
Counties Transportation Committee that the counties should expect
a decrease in Highway User funds, which is the primary financing
for the Road and Bridge Department.
SOUTHEAST IDAHO HEALTH DEPARTMENT REPORT
Leslie Talbot, Tiffany Preston and Dee Johnson presented the quarterly
report for the Health Department. They reported that flu vaccine
was still available and it was not too late to get a flu shot.
There was discussion for the landfill's need to move to a new
location and obtaining a scale to verify the tonnage being dumped
in the landfill.
PROPERTY LINE DISCREPANCY
Robert Matthews asked the Commissioners what he could do to obtain
a parcel owned by the County that bordered his property on M-Hill
in Montpelier. The County agreed to research how the property
was acquired and whether we could sell it without an auction.
BOARD OF GUARDIANSHIP
The Commissioners had previously been approached to establish
a Board of Community Guardianship for the County. Commissioner
Cochran made a motion seconded by Commissioner Kunz to appoint
Eddy Payne, Dennis Caywood, Gwen Turner, Marilyn Hadd and Dennis
Anderson to the Board with Dr. Jack Clark as an advisor. Motion
was unanimous.
ALL HAZARD MITIGATION PLAN
The Commissioners considered a proposal from Whisper Mountain
Professional Services, Inc. to prepare an All Hazard Mitigation
Plan for the County. The Plan would be paid for with FEMA funds
at no cost to the County. Commissioner Kunz made a motion seconded
by Commissioner Cochran to accept and sign the agreement contingent
on the FEMA funds being available. Motion was unanimous.
PLANNING AND ZONING
Mitch Poulsen and Judy George met with the Commissioners to discuss
Planning and Zoning issues. They were given permission to send
several members to a training session regarding subdivisions sponsored
by the Idaho Association of Cities. They requested reappointment
of several members of the Board whose terms had expired. Commissioner
Cochran made a motion seconded by Commissioner Kunz to reappointment
Judy George, Rex Skinner, Doug Taylor, Bill Stock and Richard
Armatage to three year terms. Motion was unanimous.
SCALE BID OPENING
The Commissioners opened bids for a scale at the landfill. The
scale would allow charging by weight for dumping and also help
determine if the landfill still qualifies for the small landfill
designation. The only bid submitted was from Total Scale Service
for $42,050 for a 40 foot scale and $54,050 for a 70 foot scale.
No decision was made on the purchase of the scale.
BUDGET COMMITTEE REPORT
The Voluntary Citizen Budget Committee gave their report to the
Commissioners. The Committee felt that funds such as Airport,
Fair and Weed should looked at to see if they could be self-sustaining
without a taxpayer levy. It was recommended that only County
roads should be plowed and maintained. If a new building is built
to house the Ambulance and Fire Departments, it should also be
looked at to house the Extension Office. The Committee noted
that the money donated back by the hospital should help. Increasing
building fees to support a building inspection program was suggested.
Vehicle registration and 911 fees should be raised and impact
fees imposed whenever possible. The Committee felt that an override
levy should be proposed for specific needs and capital and infrastructure
investments. The Commissioners thanked the Committee for their
work and asked if they would help with the implementation of some
of their recommendations.
POCATELLO REGIONAL TRANSIT
Ron Binggeli, Pocatello Regional Transit, reported on the bus
from Montpelier to Garden City last summer. He felt that Pocatello
Regional Transit would have to have support from local businesses
to continue the program this summer. He asked the Commissioners
for help with door to door transportation for senior citizens.
After discussion, Commissioner Kunz made a motion seconded by
Commissioner Cochran to pay $750 to help for the door to door
service through September 30th of this year. Motion was unanimous.
The Commissioners will evaluate the program at the end of the
summer season.
EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Cochran
to convene in executive session per Idaho Code 67-2345(1) to discuss
medical indigent claims. All Commissioners voted yes.
Following the executive session Commissioner Kunz made a motion seconded by Commissioner Cochran to reconvene in regular session and make the following decisions regarding medical assistance claims:
MEDICAL ASSISTANCE CLAIMS
#2007-36 - Approved - Emergency Need, Medically Indigent, Medically
Necessary, Last Resource, Obligated County.
#2007-42 - Denied - Not Medically Indigent, Not Last Resource
- Self and Veteran's Benefits.
EMPLOYEE PERSONNEL MANUAL
The Idaho Counties Risk Management Program recently updated their
recommended sample Personnel Manual. The County is in need of
updating its manual and will adapt the sample manual to fit Bear
Lake County.
TAX RELIEF
Louis Pope, Trustee of the LOC Trust, presented a petition to
cancel part of the 2006 property taxes on the Clover Creek Inn
due to hardship and casualty per Idaho Code 63-711. Mr. Pope asserted
that the neglect and lack of maintenance of a buyer of the property
caused a severe drop in the value of the property. Mr. Pope repossessed
the property in March of 2007. The Commissioners decided to take
the matter under advisement and talk to legal council prior to
making a decision.
MINUTES APPROVED
Commissioner Kunz made a motion seconded by Commissioner Cochran
to approve the Minutes of the January 8, 2008 regular meeting.
Motion was unanimous.
BILLS APPROVED
Commissioner Kunz made a motion seconded by Commissioner Cochran
to approve bills for January. Commissioners Kunz and Cochran
voted yes. Commissioner Rasmussen abstained from voting as his
company's bills are included.
Meeting adjourned subject to recall by the Chairman or his order.
