2/13/06 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners met in regular session on Monday, February 13, 2006, beginning at 9:00 A.M. in the Commissioners Room of the Courthouse Annex in Paris Idaho. Members present were Dwight L. Cochran, Chairman, Conrad E. Michaelson, Vaughn Rasmussen and Kerry Haddock, Clerk of the Board.
Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Paul Underwood, Bill Stock, Leo Pyne, Dee Johnson, Leslie Jensen and Tiffany Preston also attended the meeting.
SOUTHEASTERN DISTRICT HEALTH DEPARTMENT
Dee Johnson, Leslie Jensen and Tiffany Preston met with the Commissioners
to present the quarterly report of the District Health Department.
County Health Nurse, Leslie Jensen reported that there were 751
flu shots and 318 other immunizations given in the 4th quarter.
The County also had a routine immunization audit by the State.
Dee Johnson reported that were 4 sewer permits issued. She also
reported on a week long training session that one of the County's
solid waste employees attended.
Rosa Moosman, Editor of the News-Examiner and Reed Peterson, Montpelier Mayor joined the meeting.
ELECTED OFFICIALS MEETING
Assessor Lynn Lewis reported on his office remodeling progress.
Treasurer Rodney Wallentine reported on the Idaho Association
of Counties mid-winter legislative Conference in Boise.
CITY OF MONTPELIER
Montpelier Mayor Reed Peterson met with the Commission to discuss
several matters. He complimented the Commissioners on organizing
the joint County-City meetings and stated that he wanted to have
frequent communications with the Commission. He expressed some
concern that having the building rent of SEICAA shared between
the County and the City causes Montpelier residents to pay double
for the service. Commissioner Michaelson suggested that the Commissioners
attend occasional City Council Meetings to help promote communications
between the entities. He will visit St. Charles and Bloomington,
Commissioner Rasmussen will take Paris and Georgetown and Commissioner
Cochran will take Montpelier. Commissioner Michaelson stated that
the Economic Development Corporation reorganization would take
care of a lot of the County-City issues.
Greg Skinner, Road and Bridge Supervisor, Ardee Helm, Prosecuting Attorney, Lori Stafford, Dennis Godfrey, Al Harrison, K. B. Rasmussen and Roy Bunderson joined the meeting.
GEM TEAM
K. B. Rasmussen met with the Commissioners to discuss several
issues. He presented a list of accomplishments of the Montpelier
Gem Team. He presented a recommendation that the City of Montpelier
establish a room tax of 3% to provide funds for marketing support
for various community projects. The Montpelier Gem Team would
be responsible for administering and distributing the funds. He
presented a Montpelier City goal to establish a series of activities
designed to bring visitors into the community. Mr. Rasmussen presented
a proposed job description for a Development Administrator/Executive
Director who would have the responsibility to plan, organize and
execute fundraising and grant writing campaigns in support of
various organizations in the County. This position would act as
the executive director for the Bear Lake Development Corporation,
Montpelier Gem Team, Montpelier Community Foundation, Oregon Trail
Center and the industrial park. Mr. Rasmussen expressed his opinion
that creating and filling this position was critical to the ongoing
activities of these various entities. He presented information
about a grant that was awarded to a competing area in Idaho because
Bear Lake did not have an organization and staff to administer
the funds. Commissioner Michaelson expressed concern as to the
County's ability to spend funds to support such a position under
the Idaho Code. He also reminded that two years ago the County
put a referendum on the ballot to spend $20,000 for an Economic
Development Specialist, which was defeated by a 2 to 1 margin.
Dale Thornock and Seth Scott joined the meeting.
BAILEY CREEK ADDRESSING
Dennis Godfrey, Caribou County Emergency Management Director,
met with the Commission regarding addressing in Bailey Creek.
Caribou County provides emergency services in the Bailey Creek
area, but Bear Lake County does the addressing. Mr.Godfrey stated
that he needs to know the naming conventions of streets and to
be advised of new construction. Dale Thornock and Lori Stafford
from the Assessor's Office informed Mr. Godfrey that their office
recently took over addressing in the County. They explained the
system they were implementing and agreed to keep him informed
to accommodate him for emergency services. In the future, developers
will have to take their preliminary plats to the Assessor's Office
to have addressing on the preliminary plat.
PLANNING & ZONING ISSUES
Bill Stock approached the Commission with several Planning and
Zoning concerns. He felt that they paid too much for some office
supplies in order to keep the business local. He also stated that
the County should not have paid for the Planning and Zoning Christmas
dinner. Another concern was that the County had been paying for
secretarial help to keep minutes at Planning and Zoning meetings.
JUVENILE DETENTION JOINT POWERS AGREEMENT
Seth Scott met with the Commission to report on Juvenile Detention
and present a change in the District VI Juvenile Detention Joint
Powers Agreement to meet twice annually rather than quarterly.
The Commissioners agreed to sign the agreement.
SHERIFF'S REPORT
Sheriff Brent Bunn met with the Commission to present his monthly
report for January. He also discussed the upcoming Jail Committee
meeting.
SNOWPLOWING OF PRIVATE ROADS
Roy Bunderson met with the Commission to express concern that
the County was still plowing some private roads. He wanted clarification
of the County policy. The Commissioners stated that the policy
was to plow private roads to facilitate school bus turnarounds,
for access to diking and for emergencies. Road and Bridge Supervisor
Greg Skinner explained that there were some private roads that
were plowed because they were out of the way for a private contractor
to get to and some just because they have always been plowed.
The Commissioners asked him to put together a list of all private
roads that are being plowed for review. They also will contact
Caribou and Franklin Counties to see how they approach this problem.
HISTORICAL SOCIETY
Sherry Brown asked to have Virginia Jacobson and McKay Crane appointed
to 3 year terms on the Historical Society. She reported that the
Oregon Trail Center was moving forward and getting organized.
Commissioner Michaelson asked for financial statements and a financial
plan.
BEAR LAKE HILL CLIMBS
Paul Underwood reported that the hill climbs were very successful
and thanked the Commissioners for work provided by the County
crews. He stated it was the biggest hill climb by RMSHA this season.
LONGEVETY PAY
Roy Bunderson met with the Commission to question longevity pay
for elected officials. He felt that each term was a new period
of employment. Commissioner Rasmussen and Prosecutor Helm requested
copies of the minutes from the meeting, which established longevity
pay for further study.
BEAR LAKE SOIL & WATER CONSERVATION DISTRICT
Garth Boehme, Jeff Bartschi and Joann Taylor presented a report
on the yearly activities of the Bear Lake Soil & Water Conservation
District. They asked for their budgeted County funds of $6,450
to be released and requested the same amount be budgeted for 2007.
HARDSHIP EXEMPTION
Randy Biggs approached the Commission to ask for a hardship exemption
for his 2006 property tax. Later in the meeting, Commissioner
Rasmussen made a motion, seconded by Commissioner Michaelson to
deny the application. Motion was unanimous.
ECONOMIC DEVELOPMENT CORPORATION
Commissioner Michaelson reported on a recent meeting of the Economic
Development Corporation. He reported that they had made some changes
to the bylaws and had appointed some new members. Commissioner
Michaelson made a motion seconded by Commissioner Rasmussen to
release $15,000 that was in the budget for economic development
to the Corporation. Motion was unanimous.
RELICTED LANDS
There was a discussion of the County's lack of control of relicted
lands. The Idaho Public Lands Department controls lands exposed
from receding water of Bear Lake. Commissioner Michaelson was
concerned that there were plans for a marina to be built and that
the County had no say in the development. The County needs to
make an official request to be informed and have some input concerning
such developments.
AIRPORT MASTER PLAN
The Commissioners signed the airport master plan that had been
prepared by the County's engineering firm. The Airport Board had
reviewed and approved the plan.
MINUTES APPROVED
Commissioner Rasmussen made a motion seconded by Commissioner
Michaelson to approve the minutes of January 9, 2006 regular meeting
and January 31, 2006 special meeting. Motion was unanimous.
BILLS APPROVED
Commissioner Michaelson made a motion, seconded by Commissioner
Rasmussen to approve January's bills for payment. Motion was unanimous.

Commissioner Rasmussen made a motion seconded by Commissioner
Michaelson to adopt Resolution 2006-05 regarding the destruction
of old records per Idaho Code. Motion was unanimous.

WHEREAS, the Clerk of Bear Lake County, Idaho has deemed that it is not necessary or in the best interest of the County to retain certain records within it's possession, as the same occupy unnecessary space within the County facilities, and
WHEREAS, the Clerk of Bear Lake County has requested that said records and documents be destroyed, and
WHEREAS, the Board of County Commissioners of Bear Lake County, Idaho has reviewed the items that the Clerk of Bear Lake County desires to have destroyed, and finds that all are classified as either semi-permanent or temporary records of the County, and need not be retained more than five (5) years, or if they constitute permanent records, are more than ten (10) years old, and
WHEREAS, the Board of County Commissioners has consulted with the Prosecuting Attorney of the County in this regard.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF BEAR LAKE COUNTY, IDAHO, AS FOLLOWS:
Section 1: The following records of Bear Lake County, Idaho, and specifically the records of the Clerk of Bear Lake County, Idaho, are authorized to be destroyed:

The following Resolution was introduced by Commissioner Conrad Michaelson, read in full, considered and adopted:
RESOLUTION NO. 2006-06 OF THE BEAR LAKE COUNTY, IDAHO, SUPPORTING THE PROJECT IDENTIFICATION SUBMITTAL FOR THE CONSTRUCTION OF THE MINNETONKA CAVE ROAD TO THE LOCAL HIGHWAY TECHNICAL ASSITANCE COUNCIL, (LHTAC). TOTAL PROJECT COST ESTIMATE IS $1,842,000, WHICH WILL REQUIRE $128,940 OF LOCAL MATCHING FUNDS AVAILABLE FROM BEAR LAKE COUNTY.
BE IT RESOLVED THAT DWIGHT L. COCHRAN IS HEREBY AUTHORIZED AND DIRECTED TO SIGN THE PROJECT IDENTIFICATION PACKET AND SUBMIT TO LHTAC FOR PRIORITIZATION.

Greg Skinner discussed a letter that was sent to the Commissioners
regarding the cost of road work done by the County and charged
back to St. Charles. He also reported on several equipment breakdowns.

Commissioner Rasmussen made a motion seconded by Commissioner
Michaelson to go into Executive session per Idaho Code 67-2345
to discuss indigent cases and a personnel issue. Motion was unanimous.

WILDLAND FIRE MITIGATION AGREEMENT
Commissioner Michaelson made a motion seconded by Commissioner
Rasmussen to sign a memorandum of understanding with the Idaho
Department of Lands in support of a wildland fire mitigation agreement.
Motion was unanimous.
RESIDENCY AFFIDAVITS
The Commissioners approved residency affidavits for Junior College
scholarships for Lindsay Transtrum, Thomas Carroll, Zach Cammack,
Bruce Daines and Miles Cook.
MANAGEMENT POLICY DIRECTIVE
Clerk Haddock presented a Management Policy Directive/ Safety
Policy that had been suggested by the State Insurance Fund to
be signed by the Commissioners and distributed to the employees.
This is basically a commitment by the Commissioners to maintain
a safe work place and environment for the employees. The Commissioners
approved the document.

The Commissioners of Bear Lake County are sincerely concerned and committed to providing a safe and healthy working environment for all of our employees. We expect a high standard of safety to be followed throughout all the operations of Bear Lake County to assure the work environment is free of recognized safety and health hazards.
Accidents lead to inefficient operation by increasing cost, decreasing production and they interfere with the employee's home life and reduce company morale. As a result, Bear Lake County expects each associate from top management to the shop employees to take an active part in our safety program by following Company guidelines, using personal protective equipment, practicing safe work habits, using good judgment, thinking ahead and reporting immediately all observed hazards.
Our Accident Program has been established to identify, eliminate and to control undesired and unexpected events, which may result in physical harm or property damage. We require you to read and study the accident prevention program, learn about your roles and responsibilities and then conscientiously work in accordance with its requirements.
Bear Lake County strives to provide a safe working environment for all its employees. To this end, the Company requires a safety program be adhered to in our daily activities. Disregard of the Company safety rules and regulations may result in disciplinary action, up to and including termination of employment.
