4/27/09 Special Public Meeting Minutes:

The Board of Bear Lake County Commissioners met in a special session on April 27, 2009, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Roger Jones, Prosecuting Attorney also attended the meeting.

AGENDA
Agriculture appraisal and fence damage by snow plows were added to the agenda. Commissioner Kunz made a motion seconded by Commissioner Romrell to approve the agenda as amended. Motion carried.

EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Romrell to convene in an executive session per Idaho Code 67-2345(1)(a, b, and d) to discuss medically indigent claims, personnel issues and a legal matter. All Commissioners voted yes.

Following the executive session Commissioner Romrell made a motion seconded by Commissioner Kunz to deny medical indigent claim #2009-4 - not medically indigent and County not the last resource. Motion carried.

Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Rosa Moosman, Editor of the News-Examiner, Greg Skinner, Wayne Davidson and Bill Stock joined the meeting in progress.

PLANNING AND ZONING VACANCY
Commissioner Romrell made a motion seconded by Commissioner Kunz to appoint Brett Oxborrow to fill the vacancy on the Planning and Zoning Commission. Motion carried.

BUILDING CODE CHANGES
The Commissioners had previously discussed changes to the Building Code and held a public hearing in March. Commissioner Kunz made a motion seconded by Commissioner Romrell to amend Building Code Ordinances 2008-1 and 2008-2 by adding the International Mechanical and Fuel Gas Codes and the associated fees. Motion carried. These codes will now be administered by the County instead of the State.

BEAR LAKE COUNTY
ORDINANCE NO. 2008-1 (Amended 4-27-2009)

AN ORDINANCE OF BEAR LAKE COUNTY ADOPTING THE 2006 EDITION OF THE INTERNATIONAL BUILDING CODE; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS OR STRUCTURES IN THE UNINCORPORATED AREA OF BEAR LAKE COUNTY; ADOPTING THE 2006 INTERNATIONAL RESIDENTIAL CODE, STRUCTURAL AND LIFE SAFETY PROVISIONS, AS THEY APPLY TO DETACHED ONE AND TWO FAMILY DWELLINGS; ADOPTING THE INTERNATIONAL MECHANICAL AND FUEL GAS CODES, 2006 EDITIONS; ADOPTING THE INTERNATIONAL ENERGY CONSERVATION CODE, 2006 EDITION FOR ALL RESIDENTIAL AND COMMERCIAL BUILDINGS, EXCEPT HUD CERTIFIED MANUFACTURED HOMES; PROVIDING FOR MANUFACTURED HOMES TO BE INSTALLED UNDER TITLE 44 CHAPTER 22 OF IDAHO CODE; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFORE; PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF; REPEALING ANY AND ALL OTHER ORDINANCES AND PARTS OF THE ORDINANCES IN CONFLICT THEREWITH.

THE BOARD OF COMMISSIONERS OF BEAR LAKE COUNTY DO ORDAIN AS FOLLOWS:

Section 1. ADOPTION OF THE 2006 INTERNATIONAL BUILDING CODES:
That certain documents, three (3) copies of which are on file and are open for inspection to the public, one (1) in the Office of the Clerk of Bear Lake County and two (2) in the Office of the Bear Lake County Building Official, being marked and designated as the following:
The 2006 edition of the International Building Code (IBC), promulgated by the International Code Council, and amendments adopted under these rules together with
standards incorporated into the IBC by reference, including but not limited to, the 2006 edition of the International Residential Code (IRC) and the 2006 edition of the International Energy Conservation Code (IECC) and the 2006 edition of the International Mechanical Code(IMC) and the 2006 edition of the International Fuel Gas Code (IFGC) as promulgated by the International Code Council. Save and except such portions of the above mentioned codes as are deleted, modified or amended by provisions of this ordinance.
Shall be and the same are hereby adopted as the code of Bear Lake County for regulating the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area and maintenance of all buildings or structures in Bear Lake County providing for issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Building Code, 2006 edition published by the International Code Council, and the secondary publications references above, all of which are on file in the office of the Bear Lake County Clerk or Building Official are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance.

Section 2. DELETIONS, MODIFICATIONS OR AMENDMENTS:

All 2006 ICC Codes;
A. Insert Bear Lake County wherever [NAME OF JURISDICTION] is present.
B. All fees shall be established by the applicable governing authority under separate Ordinance or Resolution, with not more than 80% of paid fee's to be refunded, if authorized by the Building Official as allowed by code.

2006 International Building Code;
A. Sections 101.4.1 Electrical and 101.4.4 Plumbing shall be deleted, thus solely regulated under the State of Idaho IC 54-1001 and IC 54-2601.
B. Amend Section 903.2.7 by adding the following exception: Exception: Automatic sprinkler systems are not required in 3- or 4-unit Group R buildings
C. Amend Section 3410.2 inserting (adoption date) in place of [DATE TO BE INSERTED BY THE JURISDICTION]
D. All Appendices of the International Building Code, 2006 Edition, are hereby deleted.

2006 International Residential Code;
A. Table 301.2(1) shall be amended to read as follows:
Ground Snow Load = 45+, Wind Speed = 90, Seismic Design Category = C, Weathering = Severe, Frost Depth = 30", Termite = Slight/Moderate, Decay = None/Slight, Winter Design Temp = -4 (7277 HDD), Ice Shield = Yes, Flood Hazards = FIRM 160018 10/17/79, Air Freezing Index = 2000, Mean Annual Temp = 45º F.
B. Amend Section R404 by deleting Tables R404.1(1), R404.1(2) and R404.1(3) along with any reference to said Tables in Section 404.1.
C. The Exception to Section R405.1 is deleted and replaced with the following:
Exception: A drainage system is not required when the foundation is installed on well-drained ground or gravel-sand-clay mixture soils according to the Unified Soil Classification System, Group I and Group II Soils, as detailed in Table R405.1.
D. Amend Section R408.2 by adding the following exception:
Exception: Where warranted by climatic conditions, the total area of ventilation may be reduced to 1/1500 of the under-floor area where the ground surface is treated with an approved vapor retarder material and the required openings are placed so as to provide cross-ventilation of the space.
E. All electrical and plumbing requirements of Chapters 25 through 42 shall be deleted, thus solely regulated under the State of Idaho IC 54-1001 and IC 54-2601.
F. All Appendices of the International Residential Code, 2006 Edition, are hereby deleted.

Section 3. INSTALLATION OF MANUFACTURED HOMES: Manufactured Homes as defined by Idaho state Law and inspected by The Department of Housing and Urban Development (HUD), shall not be subject to the enforcement provisions of the aforesaid Building Codes, but shall be regulated and inspected as prescribed in Title 44, Chapter 22 of the Idaho Code. The owner, or an agent of the owner, must apply for and receive, an Installation Permit prior to placing any Manufactured Home on their property. No structural modifications may be made to any Manufactured Home or Manufacturers Installation Instructions unless a written site-specific structural analysis from a State of Idaho Certified Engineer or Architect has been approved, verifying the modifications compatibility with the Manufactured Home. All additions or alterations to any Manufactured Home must comply with all Building Code requirements. Multiple sections of Manufactured or Mobile Homes as well as Modular Buildings shall not be combined together or used for any other purpose except as approved by HUD at the time of manufacture. The Building Official or appointed representative is hereby authorized to permit, inspect and collect fees, as established by the governing body, for Manufactured Homes placed in Bear Lake County. Mobile or Manufactured Homes not bearing a HUD certification label shall not be allowed except as provided for by Title 44 Chapter 25 of Idaho Code.

Section 4. EXEMPTIONS: Agricultural buildings, as defined by Section 202 of the 2006 International Building Code, are exempt from building permits adopted herein but shall remain subject to placement requirements established by Bear Lake County Zoning regulations.

Section 5. PENALTIES: Violation of the provisions of this ordinance shall constitute a misdemeanor, punishable by fine of not more than $300.00, or by imprisonment not to exceed six months, or by both fine and imprisonment. Each day such violation continues it shall be considered a separate offense.

Section 6. REPEAL OF OTHER ORDINANCES / SAVINGS CLAUSE: Any and all other ordinances or parts of Ordinances in conflict herewith, are hereby repealed. All sections of the aforementioned Ordinances repealed by this Ordinance shall remain in force as to the authorization and enforcement of said Ordinances prior to the effective date of this Ordinance.

Section 7. SEVERABILITY: That if any section, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Bear Lake County Board of Commissioners hereby declares that it would have passed this ordinance, and each section clause or phrase hereof, irrespective of the fact that any one or more sections, sentences, clauses and phrases be declared unconstitutional.

Section 8. REFERENCE: Whenever "the governing body" or "local jurisdiction" is referred to in this Ordinance, or adopted codes, it shall be deemed to be referring to Bear Lake County, a political subdivision of the State of Idaho.
Section 9. BUILDING OFFICIAL: Whenever the term "authorized building official," or "building official" is referred to in the codes adopted by this Ordinance, such reference and designation shall be deemed to refer to and describe the "building official" of Bear Lake County, a political subdivision of the State of Idaho.

Section 10. EFFECTIVE DATE: That this ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect upon its due publication as provided by law, an emergency existing therefore.

AN ORDINANCE OF BEAR LAKE COUNTY ESTABLISHING THE FEES TO BE CHARGED FOR THE ISSUANCE OF BUILDING PERMITS WITHIN BEAR LAKE COUNTY; AND INSERTING THE FOLLOWING PERMIT FEE SCHEDULE, SET FORTH IN SECTION 1 OF THIS ORDINANCE AS TABLE 1-A OF THE UNIFORM BUILDING CODE, 2006 EDITION, AS ADOPTED BY BEAR LAKE COUNTY.

BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF BEAR LAKE COUNTY that the Building Permit Fee Schedule be amended as follows:

AG ASSESMENTS
Commissioner Romrell asked Assessor Lewis for information regarding increases in agriculture valuations. Lewis had previously reported that values would be higher due to higher commodity prices. Commissioner Romrell asked if higher energy costs, particularly diesel, had been considered. Mr. Lewis will check with the appraiser.

SNOW PLOW FENCE DAMAGE
The Commissioners discussed some reported damage to a fence by a County snow plow. The party will be asked to submit a claim which the County will submit to its insurance carrier.

PERSONNEL MANUAL
The Commissioners spent the rest of the meeting working on an updated personnel manual. They will use ICRMP's suggested format and revise it to fit the County's policies.

4/14/09 Special Public Meeting Notice:

The Board of Bear Lake County Commissioners will be attending the upcoming Planning and Zoning Workshop on Tuesday, April 14, 2009 at 5:00 p.m. at the Garden City Conference Center, 69 North Paradise Parkway, Garden City, Utah 84028 to hear a presentation by Kurt Hibbert on increasing density while retaining open space.

4/13/09 Commissioners Meeting Minutes:

The Board of Bear Lake County Commissioners met in regular session on April 13, 2009, beginning at 9:00 A.M. in the School District #33 Board Room in Paris, Idaho. Members present were Vaughn N. Rasmussen, Chairman, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.

Brent Bunn, Sheriff, Rodney Wallentine, Treasurer, Lynn Lewis, Assessor, Roger Jones, Prosecuting Attorney, Rosa Moosman, Editor of the News-Examiner, Rick Fawcett, Conrad Michaelson, Bill Stock, Judy George and Judy Hyde also attended the meeting.

AGENDA
Discussion of a solid waste issue was added to the agenda. Commissioner Romrell made a motion seconded by Commissioner Kunz to accept the agenda as amended. Motion carried.

MINUTES APPROVED
Commissioner Kunz made a motion seconded by Commissioner Romrell to approve the minutes of the March 9, 2009 regular meeting. Motion carried.

ELECTED OFFICIALS MEETING
Sheriff Brent Bunn presented his monthly report. He reported that the average jail population for March was 6.5 with medical costs of $1,834. He reported on progress with the neighborhood watch program. The Commissioners approved his request to apply for federal stimulus money to pay for an additional officer for three years. The officer would be a school resource officer during the school year. Assessor Lynn Lewis reported that assessment notices would be mailed in May.

NATIONAL FLOOD INSURANCE
Mary McGown, State Floodplain Coordinator, and Dave Jackson, State Hazard Mitigation Officer presented information on the National Flood Insurance Program. They explained the advantages of becoming a member of the program and outlined steps to join. Following the presentation, Commissioner Kunz made a motion seconded by Commissioner Romrell to move ahead with the program. Motion carried. Rick Fawcett will pursue hazardous mitigation grant money to prepare a flood plain map.

COMMITTEE REPORTS
Commissioner Romrell reported on meetings with the Airport and Fair Boards. He had expressed to both that they need to be more transparent and need to follow open meeting laws. He reported on upcoming improvements that will be financed mostly by FAA grants.

JUVENILE CORRECTIONS UPDATE
Bill Lasley, District 6 Juvenile Corrections, presented an update on State funding for Juvenile Corrections. He noted that final numbers were not yet available, but he expected a decrease in state support.

GEORGETOWN IMPACT AREA
Mitch Poulsen and Judy George, Planning and Zoning presented a revised impact area for the City of Georgetown. The area was smaller than what had originally been proposed stating that they need to include only areas where the City can provide services.

REGIONAL PLANNING
The Commissioners discussed the need for regional planning with Rich County in the Bear Lake Valley. Commissioner Rasmussen stated that the Bear Lake Regional Commission was the proper entity to coordinate these efforts. The Regional Commission, with the help of Rick Fawcett, will apply for a rural development grant to facilitate this process.

PLANNING AND ZONING SEMINAR
Judy George, Planning and Zoning stated that the Bear Lake Regional Commission was sponsoring a Planning and Zoning seminar in Garden City the next day.

WHISPER MOUNTAIN CONTRACT
Rick Fawcett presented an Independent Contractor's agreement to provide consulting services to Planning and Zoning and prepare a transportation overlay for the County.

After discussion, Commissioner Romrell made a motion seconded by Commissioner Kunz to sign the contract. Motion carried.

BEAR RIVER HERITAGE DESIGNATION
Judy Holbrook met with Commissioners to ask for a letter of support for establishing a National Bear River Heritage Area. This would be done by a bill in Congress sponsored by local Legislators. Commissioner Romrell made a motion seconded by Commissioner Kunz to send letters of support to the local Legislators. Motion carried.

BIOGREEN CONFIDENTIALITY AGREEMENT
The Commissioners discussed a confidentiality agreement with a company that wanted to explore a regional landfill that would create energy out of the garbage. The Commissioners would agree not to disclose the technical details of the process. After conferring with County Attorney Roger Jones, Commissioner Kunz made a motion seconded by Commissioner Romrell to sign the Agreement. Motion carried.

BLACK BEAR MOUNTAIN UPDATE
Bruce Barrett and Ted Galovan met with the Commissioners to provide an update on the Black Bear Mountain Resort. They reported that credit markets were improving and that they had several transactions in process that would help them get current with short term obligations. The economy was still very week and progress was very slow. They agreed to provide an anticipated timeline for the next meeting.

PUBLIC COMMENT PERIOD
Public comments included concerns regarding the Department of Water Resources' meeting on the Black Bear Mountain water application and concern over liens that had been filed on the resort.

EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Romrell to convene in an executive session per Idaho Code 67-2345(1)(a, b, and d) to discuss medically indigent claims, personnel issues and a legal matter. All Commissioners voted yes.

Following the executive session, Commissioner Kunz made a motion seconded by Commissioner Romrell to act on the following medical indigent claims: #2008-33 - Denial upon reconsideration - not medically indigent; not last resource; provider, Bear Lake Memorial Hospital withdrew appeal/application. #2008-26 - Approved - Medically indigent; medically necessary, obligated County; emergency need; last resource.

BOAT SAFETY GRANT
Kirk Rich from the Bear Lake State Park presented boat safety grants for approval. Money to fund the grants comes from boater fees. He also noted that there would be an additional $10.00 fee this year to fund Quagga Mussel control. The State budget for parks had been cut considerably with less money for part time help this summer. Commissioner Kunz made a motion seconded by Commissioner Romrell to approve and sign the boat safety grants. Motion carried.

ROCKY MOUNTAIN POWER EASEMENT
Yuka Jenkins, Rocky Mountain Power updated the Commissioners on progress to define the easement needed to get power to the Hell Hole repeater site. They were waiting for a decision regarding underground versus overhead power lines.

PERSONNEL MANUAL
The Commissioners discussed progress on updating the County's Personnel Manual to conform to ICRMP's suggested manual. They scheduled a work meeting to work through the details for April 27.

WATER QUALITY PRESENTATION
Mitch Poulsen, Planning and Zoning presented information to the Commissioners on projects that have been completed by the Bear River Water Quality Task Force. He presented information regarding several agencies that had done projects in the Bear River drainage.

INTERLOCAL EMERGENCY SERVICES AGREEMENT
Mitch Poulsen, Planning and Zoning presented an interagency emergency cooperation agreement that the Bear Lake Regional Commission was working to have adopted by States, local Governments and local emergency services agencies. A recent Idaho Supreme Court decision made it questionable as to whether agencies could cross State lines in support of each other. He will be working with the Attorney Generals from both States in pursuit of the agreement.

SOLID WASTE ISSUES
Todd Transtrum, Solid Waste Supervisor talked to the Commissioners about the bag of woad program. He felt it was educational to youth who were involved as well as getting rid of some of the weeds. Commissioner Romrell stated that land owners needed take some responsibility for weeds on their property. Mr. Transtrum also presented a proposal to do some long range planning at the land fill.

ROAD AND BRIDGE ISSUES
Greg Skinner, Road Supervisor received approval to submit an application for Federal stimulus money to upgrade the Dingle to Hot Springs Road. He also discussed several stimulus projects with which the County will be assisting the Forest Service. The Commissioners also discussed the proposed grader purchase. Following a short discussion Commissioner Kunz made a motion seconded by Commissioner Romrell to purchase the 160M grader and trade an old grader #51 subject to the new grader matching the GSA purchase price. Motion carried.

CTD OIL AND GAS LEASES
Dick Padon approached the Commissioners regarding oil and gas leases on County road right of ways. They will be doing seismic work in the County this summer. The Commissioners wire agreeable to working with CTD.

LEGISLATIVE RETREAT
Jesse Taylor presented details of the Legislative Retreat at Bear Lake scheduled for June 27. He was hopeful that numerous State Officials from both Idaho and Utah would attend the conference. He also requested that the County help fund the event along with many other Government entities and Civic organizations. Commissioner Romrell made a motion seconded by Commissioner Kunz to make a $1500 commitment from the Commissioners travel budget to the project. Motion carried.

BEAR LAKE TRANSLATOR DISTRICT
The Commissioners considered a request of the Translator District to appoint two new members. Commissioner Kunz made a motion seconded by Commissioner Romrell to appoint Jim Parker and Carl Beck to fill the positions. Motion carried.

PLANNING AND ZONING APPOINTMENT
The Commissioners discussed a new member for the Planning and Zoning Commission and decided to take the matter under advisement until the April 27th meeting.

BILLS APPROVED
Commissioner Romrell made a motion seconded by Commissioner Kunz to approve Bills for March, 2009. Commissioners Romrell and Kunz voted yes. Commissioner Rasmussen abstained as bills from the company he works for were included.
