4/9/07 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners met in regular session on Monday, April 9, 2007 beginning at 9:00A.M., in the Commissioners Room at the Courthouse Annex in Paris, Idaho. Members of the Board present were Vaughn Rasmussen, Chairman, Dwight Cochran, Montain Kunz and Kerry Haddock, Clerk of the Board.
Lynn Lewis, Assessor, Rodney Wallentine, Treasurer, Brent Bunn, Sheriff, Rosa Moosman, Editor of the News-Examiner, and Bill Stock also attended the meeting.
BLOOMINGTON CEMETERY DISTRICT
Mark Wilson, President of the Bloomington Cemetery District, requested
help from the County with grading and graveling the approach road
to the Cemetery. The Commissioners agreed to do some work on
the road to the Cemetery, but not inside the Cemetery.
ELECTED OFFICIALS MEETING
Treasurer Rodney Wallentine reported that he was down to four
owners with property he would tax deed. Sheriff Bunn presented
his monthly report. The number of prisoners was down slightly
for the month. One of the prisoners has large medical bills.
Assessor Lewis reported that he would soon be sending out assessment notices. Values in some parts of the County would be higher than last year.
MEETING PROCEDURES
Commissioner Rasmussen discussed changes in meeting procedures
he wanted to adopt. He explained that Commissioner Meetings were
public meetings, but not public hearings. Members of the public
would need to be on the agenda to have input during the meetings.
He presented a few other procedures designed to make meetings
run more efficient and on time.
MINUTES APPROVED
Commissioner Kunz made a motion seconded by Commissioner Cochran
to approve the minutes of the March 12, 2007 regular meeting and
the March 29, 2007 special meeting. Motion was unanimous.
SPRING BREAK-UP - ROADS
Greg Skinner, Road and Bridge Supervisor, approached the Commissioners
regarding reduced weight limits and speed limits during spring
road break-up. He has seen considerable damage this spring.
He presented a copy of a resolution that Bannock County passes
each spring. These regulations are difficult to enforce, but
do make the public aware of the problem. Commissioner Cochran
made a motion seconded by Commissioner Kunz to draft an Emergency
Resolution for reduced weight limits and speed limits. Motion
was unanimous. A notice will be published in the paper asking
for public cooperation. Resolution to be adopted at May's Commissioner's
Meeting.
LANDFILL ISSUES
Mr. Skinner also addressed several landfill issues. He would
like to see the Landfill be a separate department. We need to
be sure landfill fees are covering the costs associated with the
landfill. He discussed our small landfill designation and when
we might lose it.
BANKRUPTCY TAXES
Treasurer Wallentine presented an offer of a company in bankruptcy
to pay pre-petition taxes if the County would forgive penalty
and interest. After a short discussion Commissioner Kunz made
a motion seconded by Commissioner Cochran to accept the offer.
Motion was unanimous.
Leo Pyne, Alan Eborn, Max Bunderson, Alan Lloyd and Roy Bunderson joined the meeting in progress.
TRAILER AT FAIRGROUNDS
The Commissioners discussed complaints they had received regarding
a trailer parked at the fairgrounds. Max Bunderson, Fair Board
Chairman, explained that the Fair Board had previously rented
space to this individual and that it was similar to leasing storage
space in the winter. The Commissioners asked Mr. Bunderson to
discuss this at the next Fair Board meeting and to come back with
their recommendation. They also asked for a recommendation regarding
dogs and leash rules.
JAIL COMMITTEE
Reed Miller met with the Commissioners and members of the jail
committee regarding the status of the feasibility study. There
had been some confusion regarding the next step in the process.
A meeting was scheduled for April 16, 2007 with the full Jail
Committee to clarify the process.
OUTLET CANAL BRIDGE CLOSLURE
The Idaho Transportation Department had informed the County that
they will build the new outlet canal bridge this winter. The
bridge will be out of service from about mid October to mid April.
It was decided to advertise in the paper and also place signs
on the bridge regarding the closure to inform users of the bridge.
TRAILER PUP BID
Bids were opened for the pup trailer for the Road and Bridge Department.
The only bid received was from Tesco Williamsen in Salt Lake
City for $35,198.00. Commissioner Kunz made a motion seconded
by Commissioner Cochran to accept the bid. Motion was unanimous.
AIRPORT HAY BIDS
Bids were opened for the hay at the airport. The following bids
were received:
Fred Nate - South of airport $3,050.00. North
of airport $1,500.00.
Chad Hulme - South of airport $2,410.00. North of airport $1,720.00.
Commissioner Kunz made a motion seconded by Commissioner Cochran
to accept the high bids of Fred Nate for the south $3,050.00 and
Chad Hulme for the north $1,720.00. Motion was unanimous.
COURT DECISIONS AND COUNTY ISSUES
Roy Bunderson brought two Supreme Court cases to the attention
of the Commissioners. One confirmed that the driver of a vehicle
is liable when cattle are hit on open range land.
The second overturned a lower court decision and affirming that
public entities require voter approval prior to incurring debts
or liabilities. He also asked for updates on building permit
enforcement, the County obtaining legal ownership to Allinger
Park, enforcement of the solid waste junk ordinance and the issue
of plowing private roads.
SPEED WARNING SIGN
Bill Stock asked the Commissioners to request that the portable
speed warning sign be placed in Fish Haven. The Commissioners
agreed to ask the Department of Transportation to do this.
RESIDENCY AFFIDAVIT
Commissioner Cochran made a motion seconded by Commissioner Kunz
to approve the certificate of residency for Junior College tuition
for Kristal Derricott. Motion was unanimous.
BILLS APPROVED
Commissioner Cochran made a motion seconded by Commissioner Kunz
to approve the current bills. Motion was unanimous.
SOIL CONSERVATION DISTRICT
Joann Taylor and Steve Smith from the Soil and Water Conservation
District met with the Commissioners regarding planning and zoning
issues. They pointed out that they have similar issues and offered
to assist Planning and Zoning with their resources. The Commissioners
asked them to meet with Planning and Zoning at their next meeting.
EXECUTIVE SESSION
Commissioner Kunz made a motion seconded by Commissioner Cochran
to convene in an executive session per Idaho Code 67-2345(1) to
discuss medically indigent cases. All Commissioners voted yes.
Following the executive session Commissioner Kunz made a motion seconded by Commissioner Cochran to reconvene the regular meeting to act on the following indigent cases:
#2007-06 - Approved: Medically Indigent; Obligated County; Last Resource; Emergency Need; Medically Necessary; Resident.
#2007-08 - Denied: Not indigent; Not the last resource; Application incomplete; Applicant didn't cooperate with the County.
#2007-09 - Denied: Pending Disability Claim; Not the last resource; Not indigent.
#2007-10 - Denied: Not indigent; Not the last resource.
Meeting adjourned subject to recall by the Chairman or his order.
